(Washington, DC / Fairfax County, VA) Judicial Watch, the public interest group that investigates and prosecutes government corruption, today threatened legal action against the County of Fairfax, VA in order to prevent taxpayer funding for three proposed illegal alien job centers – termed “Day Laborer” sites – among them a site in Herndon, over which Judicial Watch has already filed suit on behalf of the town’s citizens. The two other sites are in the Culmore and Annandale districts of Fairfax County.
Judicial Watch sent a letter to the Fairfax County Board of Supervisors on September 7, 2005 detailing the legal concerns and objections of its clients. The Clerk of the Board confirmed to Judicial Watch that all ten Fairfax supervisors received Judicial Watch’s letter on September 8, 2005. Paul Orfanedes, Judicial Watch’s Director of Litigation will make a statement of concerns and intentions to a meeting of the Fairfax County Board of Supervisors Monday, September 12th. The public hearing portion of the regularly scheduled meeting of the Board begins at 10 AM at the Fairfax Government Center, 12000 Government Center Parkway in Fairfax.
Judicial Watch represents concerned citizens and residents of the Town of Herndon and Fairfax County in this matter.
Prior to filing a lawsuit against the Town of Herndon in Fairfax County Circuit Court on September 1st, Judicial Watch gave ample warning, both written and verbal, to the Herndon Town Council, as well as Fairfax and Loudon County officials putting them on legal notice and detailing Herndon citizens' objections to the proposed Day Laborer site.
Federal law prohibits employers from hiring undocumented workers. It is also illegal to “encourage or induce an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of the law.” In addition, a Virginia statue that becomes effective January 1, 2006 provides that “no person who is not a United States Citizen or legally present in the United States shall receive state or local public assistance…except for state or local public assistance that is mandated by Federal Law…”
“The Fairfax County Board of Supervisors should comply with the law and kill any funding for illegal day labor sites,” said Judicial Watch President Tom Fitton. “Simply put, local governments must not subvert federal law.”
