JUDICIAL WATCH TO REFILE CLAIMS AGAINST DEFENDANTS IN LORAL/CHINAGATE LAWSUIT

Judge Says State Claims May Be Refiled


(Washington, DC) Today, the Honorable Royce C. Lamberth of the U.S. District Court for the District of Columbia, dismissed the RICO claims of Judicial Watch’s clients against Bernard Schwartz, Loral, and others over allegations concerning illegal fundraising activities by the Clinton-Gore Administration. Judge Lamberth declined to exercise the Court’s discretion to “supplemental jurisdiction” with regard to a number of state claims which survived defendants’ motion to dismiss. However, he suggested that Plaintiffs could refile their other claims in state court, and held: “Denying a RICO claim in this case would not shield the alleged wrongdoers from liability, nor would it prevent the [Loral] shareholders [plaintiffs] from seeking other remedies.”

“Judicial Watch will take an appeal of Judge Lamberth’s dismissal of the RICO claims and refile the other claims in state court. This case -- involving allegations that our national security was compromised in exchange for campaign contributions -- is of crucial importance to this country,” stated Judicial Watch President Tom Fitton.
