JOINT STATEMENT IN RESPONSE TO INITIAL GRAND JURY RESPONSE CONCERNING CRIMINAL CHARGES AGAINST GARY CONDIT

(Washington, DC) Tonight, Jim Robinson, Esq., and Larry Klayman Chairman and General Counsel of Judicial Watch, Inc., co-counsel for Anne Marie Smith, issued the following statement in response to a Stanilaus County Grand Jury's decision not to investigate conspiracy to obstruct justice and subordination of perjury by Gary Condit. The grand jury incredulously claimed it did not have subject matter jurisdiction.

Gary Condit should continue to worry about the law finally catching up with him. The grand jury is mistaken as both a matter of law and of fact. It is within the jurisdiction of the Stanislaus Grand Jury to investigate these crimes, which occurred in his very county. We fear that the grand jury was misled on the law by the local district attorney. Nevertheless, we are heartened that the grand jury did not reject the basis of our complaint. Undaunted, we will pursue justice in other venues which also have jurisdiction, such as San Francisco and San Mateo counties. We will also resubmit our complaint to the Stanislaus grand jury with a legal brief showing conclusively that it has subject matter jurisdiction, as there was alleged illegal activity in the county. We are committed to giving our brave client Anne Marie Smith her day in court. She and the people of California are the victim of several crimes by Congressman Condit and they deserve due process of law. If the Stanislaus County's Grand Jury will not hear her plea for justice, we will go elsewhere.
