Landmark Lawsuit on Behalf of September 11 Victims to Drain Funds from Iraq and Al Qaeda


As the “war against terror” winds down in Afghanistan, there is an internal battle brewing in the Bush Administration as to whether or not Iraq ought to be the next target of American retribution. At Judicial Watch no such indecision exists.

Evidence clearly implicates Iraq and Saddam Hussein in the September 11 attacks that murdered more than 3,000 people on American soil.

On December 4, JW filed suit in a Washington, DC federal court where other terrorist victims have already won big judgments against Iraq and Iran. The suit, filed on behalf of the widower of a World Trade Center victim, names the government of Iraq, Osama bin Laden, Al Qaeda and the Taliban as defendants.

“The evidence is overwhelming that Iraq was involved in the September 11 attack which murdered our client’s wife,” said JW Chairman Larry Klayman. “We are confident a jury will agree.”

The connection between Hussein and Osama bin Laden’s Al Qaeda network has been well documented in press reports.

According to the New York Times, Mohammed Atta, the man who served as bin Laden’s ringleader in the attacks, flew from Florida to Prague on April 8 of this year for a covert meeting with Ahmed al-Ani, the Iraqi counsel. Multiple press reports have also documented other meetings between other bin Laden terrorists and Iraqi intelligence officers in the months leading up to September 11.

The New York Times also reports that Saddam’s personal doctor Mohammed Khayal was escorted to Afghanistan by Iraqi Secret Service agents to tend to Osama bin Laden, who is known to have suffered kidney problems.

At least two Iraqi defectors have testified they worked for several years at a secret Iraqi government camp south of Baghdad that trained Islamic terrorists, including bin Laden foot soldiers. According to one of the defectors, a former general, the camps were designed to train radicals to attack installations important to the United States, and included lessons on how to take over a plane without the use of weapons.

The CIA reportedly believes Iraqi intelligence provided “material support and assistance” to bin Laden’s network to carry out the attacks, including passports for the hijackers.

According to testimony provided to Congress by two bioterrorism experts, the “footprint” of the anthrax-laced letters sent to Senators Daschle and Leahy in the wake of the attacks is Iraqi, suggesting possible coordination with bin Laden’s Al Qaeda network.

“Given the preponderance of evidence linking Hussein and bin Laden, the Administration’s hesitation is unwarranted,” said JW Chairman Larry Klayman. “Some in our government may choose to ignore Iraq’s role in the attacks. Judicial Watch will not.”

JW seeks damages under the Anti-Terrorism Act and the Foreign Sovereign Immunities Act.
