Judicial Watch Victory! Judge Orders CIA to Turn Over Docs in Trulock Case
On March 31, 2003, Judge Emmet Sullivan ruled in favor of Judicial
Watch, and ordered the CIA to turn over documents pertaining to JW’s
case on behalf of Notra Trulock. Mr. Trulock has several legal actions
pending against Clinton administration officials who targeted him
with an unlawful smear campaign after he wrote an article critical
of the FBI. The CIA is attempting to withhold documents that could
contain crucial evidence to bolster Judicial Watch’s case. Judge
Sullivan, however, has demanded a review of the documents.
"The Court is indeed persuaded that the CIA has not provided
sufficient information through affidavits and descriptions of the
documents fully and partially withheld to permit the Court to rule
on the CIA’s claims of statutory exemptions," wrote Judge
Sullivan. "Accordingly, the Court shall direct defendant CIA
to submit all documents withheld in whole or in part of in camera
review, to enable the Court to ascertain whether the claimed exemptions
apply."
Mr. Trulock was the government whistleblower who discovered and reported
serious breaches in national security. He and his investigators discovered
that nuclear secrets were missing from Los Alamos Nuclear Laboratory,
and possibly put in the hands of the Communist Chinese.
After Mr. Trulock wrote an article critical of the FBI’s handling
of the investigation, he was
subjected to an illegal and unconstitutional FBI raid during which
his computer and files were illegally seized. The FBI neither had
a warrant nor the consent of Trulock or his landlord to conduct the
illegal search and seizure.
Among several other lawsuits, Judicial Watch represents Mr. Trulock
in a civil rights lawsuit against former FBI Director Louis Freeh.
The complaint alleges that Freeh ordered the illegal search and seizure
of Mr. Trulock¹s home and property in retaliation for Mr. Trulock’s
article.
In January 2001, an appeals court ruled that the case against Freeh
can move forward, noting that, "the timing of the search raises
an inference of retaliatory motive [by Louis Freeh and others]."
Freeh is scheduled to be deposed on May 23, 2003.
"We are encouraged by Judge Sullivan’s order and are
confident that Mr. Trulock will prevail in having the government
turn over the records and files it maintains on him," said
JW Chairman Larry Klayman. "Honorable, honest citizens, such
as Mr. Trulock, should not be the subject of secret government files
and coordinated government efforts to threaten and intimidate them."
