The fifth amendment only applies to criminal matters? Guess what? drug abuse is a criminal matter, even at the work place. Who's to say that a positive result wont be turned over to the authorities? If it were, would it be admissible? If it's admissible, doesn't that violate the fifth amendment? Why can't employers use water boarding? It's legal in the USA. And if you want a job, why not let the employer torture you for it? If background checks are disallowed, water boarding may be a viable alternative.
