			<content:encoded><![CDATA[<p><span style="font-family: Times New Roman;">Judicial Watch announced today that it has filed two lawsuits against the U.S. Department Homeland Security (DHS) for failure to respond to its requests for public records under the Freedom of Information Act (FOIA).  The documents relate to the nature of <span style="color: #000000;">health services and birth control services </span>prescribed and/or provided to female and transgender detainees of U.S. Immigration and Customs Enforcement (ICE) based on revised detention standards published by ICE in 2011 (<em>Judicial Watch v. United States Department of Homeland Securit</em><em>y</em> (No. <a href="http://www.scribd.com/doc/118124446/DHS-Suit-Birth-Control">12-cv-0215</a> and No. <a href="http://www.scribd.com/doc/118124754/DHS-Suit-Transgender">12-cv-0216</a>)).</span></p>
<p><span style="font-family: Times New Roman;"> </span><span style="font-family: Times New Roman;">As stated in the ICE document </span><a href="http://www.ice.gov/detention-standards/2011/"><em><span style="color: #0000ff; font-family: Times New Roman;">Performance-Based National Detention Standards 2011</span></em></a><span style="font-family: Times New Roman;">, “upon request, appropriately trained medical personnel within their scope of practice shall provide detainees with non-directive (impartial) advice and consultation about family planning and birth control, and where medically appropriate, prescribe and dispense birth control.”  The revised standards also specify conditions under which “ICE will assume the costs associated with a female detainee’s decision to terminate a pregnancy” in the case of rape or incest.</span></p>
<p><span style="font-family: Times New Roman;">With regard to transgender detainees, the document notes that those “already receiving hormone therapy when taken into ICE custody shall have continued access to” and shall be provided with “transgender-related health care and medication based on medical need.”</span></p>
<p><span style="font-family: Times New Roman;">On September 24, 2012, Judicial Watch sent a FOIA request to ICE, which is part of the DHS, seeking access to the following:</span></p>
<ul>
<li><span style="font-family: Times New Roman;">Any and all records pertaining to family planning or birth control services provided to detainees in ICE’s custody.</span></li>
</ul>
<ul>
<li><span style="font-family: Times New Roman;">Any and all records pertaining to the termination of pregnancies by female persons in ICE’s custody, including records concerning transportation arranged for or provided to detainees for the purpose of receiving abortion services and any and all records regarding costs associated with such services.</span></li>
</ul>
<p><span style="font-family: Times New Roman;">On the same day, Judicial Watch sent a separate FOIA request to ICE seeking access to any and all records pertaining to hormone therapy and other health care services and medications provided to transgender detainees of ICE, as well the cost of any such services.</span></p>
<p><span style="font-family: Times New Roman;">In both cases, the records being sought are for Fiscal Year 2011, or from October 1, 2010, through September 30, 2011.  The requests specifically stated that no information was being sought about the identity of any detainee or health care provider.</span></p>
<p><span style="font-family: Times New Roman;">ICE has acknowledged receipt of both requests. A response regarding Judicial Watch’s request for records related to birth control services was due on November 19, 2012. A response to Judicial Watch’s request for records related to health services for transgender detainees was due on November 6, 2012. To date ICE has failed to respond to either these FOIA requests, prompting Judicial Watch’s lawsuits.</span></p>
<p><span style="font-family: Times New Roman;">“It will surprise most Americans to know that illegal alien detainees can receive birth control, sex change procedures, and abortions courtesy of the U.S. taxpayer,” said Judicial Watch President Tom Fitton. “This is an embarrassing scandal for the Obama administration, which is why the administration has violated the law in refusing our requests for information.”</span></p>

			<content:encoded><![CDATA[<p>The Obama backdoor amnesty plan is in full force, with a record amount of illegal immigrants spared from deportation and a huge increase in the number of those allowed to remain the United States.</p>
<p>The shift is striking, according to the nonprofit university group that obtained government records outlining the drastic change. The New York-based nonpartisan research center, Transactional Records Access Clearinghouse (TRAC), provides detailed information about the operation of hundreds of government agencies.  Immigration is one of many areas it researches.</p>
<p>This week TRAC revealed that during the first three months of fiscal year 2012, cases disposed of in the nation’s immigration courts showed a <a href="http://trac.syr.edu/immigration/reports/272/" target="_blank">serious drop </a>in deportation orders and an increase in the number of individuals allowed to stay in the U.S. That means that individuals were ordered removed in only half of the cases, the lowest rate in the past two decades.</p>
<p>An additional 14.0 percent received a &#8220;voluntary departure&#8221; order to leave the country, up slightly from 13.2 percent during the previous quarter, the records show.  Counting both removal and voluntary departure orders, slightly fewer than two out of every three cases (64.8 percent) in the first quarter of fiscal year 2012 ended in a deportation order, also a historic low.</p>
<p>The government records also show that, among individuals determined by Immigration and Customs Enforcement (ICE) to have violated immigration laws, more than one in three (34.4 percent) were allowed to stay in the U.S. This also represented a historic high, which is illustrated in a chart that includes figures for the last several years.</p>
<p>Clearly, the Obama Administration’s stealth amnesty plan to suspend the deportations of most illegal aliens is in play here. The scandalous measure, which has led to a monstrous increase in the dismissal of deportations, was first reported by <a href="http://www.chron.com/news/article/Feds-moving-to-dismiss-some-deportation-cases-1706119.php" target="_blank">Texas’s largest newspaper </a>in 2010. Shortly after the story broke, Judicial Watch requested records on the deportation suspensions from the Department of Homeland Security (DHS) under the Freedom of Information Act (FOIA).</p>
<p>After DHS stonewalled the release of records for nearly a year, JW filed a lawsuit last spring. A few weeks ago the United States District Court for the District of Columbia issued a <a href="http://www.judicialwatch.org/press-room/press-releases/court-criticizes-obama-dhs-on-stealth-amnesty-document-foia-secrecy-in-judicial-watch-suit/" target="_blank">ruling </a>criticizing the Obama DHS for failing to abide by FOIA law. U.S. District Judge Colleen Kollar-Kotelly chastised the agency for its inadequate explanations for withholding certain documents, ruling in part that the agency failed to provide sufficient factual context for much of the information withheld.</p>
<p>While on the combined subject of lying and illegal immigration, last month TRAC exposed DHS <a href="http://www.judicialwatch.org/blog/2012/01/ices-own-data-fails-to-back-enforcement-claims/" target="_blank">records</a> that show the agency repeatedly lied to Congress, the American people and the media by drastically increasing the number of individuals that have been apprehended, deported or detained. 			<content:encoded><![CDATA[<p>The Department of Homeland Security (DHS) has distributed $19 million to nonprofit establishments in urban areas that are considered at high risk of a terrorist attack, including abortion clinics and an Islamic center.</p>
<p>The idea is to give the groups the necessary resources to improve security and make them less susceptible to an attack. The DHS calls it <a href="http://www.fema.gov/government/grant/nsgp/">“target hardening activities”</a> and the official program is known as Urban Areas Security Initiative, specifically the Nonprofit Security Grant Program.</p>
<p>A total of 269 nonprofits across the U.S., all considered high-threat, high-density urban areas, will split the cash and the money will be used for security-related training and to install physical security equipment. The goal is to help them prevent, respond and recover from acts of terrorism.</p>
<p>But a look at the long <a href="https://www.judicialwatch.org/files/documents/2011/fema-docs-12022011.pdf">list of recipients</a> raises questions about how the money is allocated for this particular cause. While the majority of the grants went to Jewish centers and groups that could feasibly be targeted by radical Islamic terrorists, some are private medical facilities, catholic groups and a profitable Baptist hospital. In California and New York Planned Parenthood abortion clinics got the target hardening grants.</p>
<p>In Maryland, the <a href="http://www.isb.org/default.aspx">Islamic Society of Baltimore</a> got a target hardening grant as well as an interfaith center that includes a Roman Catholic church and a Methodist/Presbyterian church. All 30 of the grants distributed in Illinois went to Chicago-area nonprofits, including a politically-connected college foundation with more than $5 million in assets and several Catholic hospitals.</p>
<p>Funds are allocated based on risk analysis, effectiveness and integration with broader state and local preparedness efforts, according to the DHS. To be considered, nonprofits must demonstrate that they are at high risk of a terrorist attack and located within one of the specific eligible urban areas. How exactly does a group do this?</p>
<p>The government has a <a href="http://www.fema.gov/pdf/government/grant/2011/fy11_nsgp_kit.pdf">formula</a> that includes the following: Identification and substantiation (e.g., police reports or insurance claims) of prior threats or attacks against the nonprofit or closely related group by a terrorist organization, network, or cell ;  symbolic value of the site as a highly recognized national or historical institution that renders it as a possible target of terrorism; role of the applicant nonprofit organization in responding to or recovering from terrorist attacks; findings from previously conducted risk assessments including threat or vulnerability.</p>

			<content:encoded><![CDATA[<p>The Obama amnesty plan officially begins this week, according to a mainstream newspaper that obtained internal Homeland Security documents outlining <a href="http://www.nytimes.com/2011/11/17/us/deportation-cases-of-illegal-immigrants-to-be-reviewed.html?_r=2&amp;hp">“sweeping changes”</a> in immigration enforcement that will halt the deportation of illegal aliens with no criminal records.</p>
<p>Much has been reported about the administration’s intention to implement a stealth amnesty plan if congress doesn’t act to spare the nation’s estimated 12 million illegal aliens, but this is the first confirmation that it’s come to fruition. Beginning this week the Department of Homeland Security (DHS) will review all deportation cases and start a nationwide “training program” to assure that enforcement agents and prosecuting attorneys don’t remove illegal immigrants who haven’t been convicted of crimes.  </p>
<p>About 300,000 immigration cases are currently pending before overwhelmed U.S. courts and the goal is to expedite them, according to DHS officials cited in the news report. To accomplish this, the agency will focus on removing only those who committed serious crimes or pose a national security risk. Immigration agents will be instructed to close deportations that “fall outside” these department “priorities,” which means a large class of illegal aliens will be granted de facto amnesty.</p>
<p>This backdoor amnesty plan has been in the works for some time and has actually been implemented unofficially for more than a year. In fact, in 2010 Texas’s largest <a href="http://www.chron.com/news/article/Feds-moving-to-dismiss-some-deportation-cases-1706119.php">newspaper</a> published an exposé about a then-secret DHS initiative that systematically cancelled pending deportations. The remarkable program stunned the legal profession and baffled immigration attorneys who say the government bounced their clients’ deportation even when expulsion was virtually guaranteed.</p>
<p>Judicial Watch has been a front runner in investigating the Obama Administration’s stealth amnesty program by pursuing DHS records concerning “deferred action” or “parole” to suspend removal proceedings against a particular group of individuals. Earlier this year JW <a href="https://www.judicialwatch.org/news/2011/mar/jw-files-two-lawsuits-against-obama-department-homeland-security-records-detailing-all">sued </a>DHS to obtain information because the agency ignored a federal public records request that dates back to July 2010.</p>

			<content:encoded><![CDATA[<div class="mwm-aal-container"><div class='mwm-aal-title'>Contents</div><ol><li><a href="#documents-uncovered">Documents Uncovered</a></li></ol></div><p>Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has obtained documents from the Obama Department of Homeland Security (DHS) detailing behind-the-scenes efforts by the Obama administration to bypass Congress and grant amnesty at least one million illegal aliens by suspending immigration deportation proceedings against “DREAM (Development, Relief, and Education for Alien Minors) Act kids” and other illegal aliens. The records include internal DHS strategic documents, as well as extensive email communications within the DHS and with the Obama White House. The documents were obtained by Judicial Watch as a result of two Freedom of Information Act (FOIA) lawsuits filed on March 23, 2011 (<em><a href="https://www.judicialwatch.org/judicial-watch-v-u-s-department-homeland-security-8">Judicial Watch v. U.S. Department of Homeland Security</a></em> (No. 11-604) and <em><a href="https://www.judicialwatch.org/judicial-watch-v-u-s-department-homeland-security-7">Judicial Watch v. U.S. Department of Homeland Security</a></em> (No. 11-606)).</p>
<p>The records include emails from press outlets investigating the Obama administration’s efforts to suspend the deportations of students who would be covered under The DREAM Act, which was under consideration by Congress. The DREAM Act would have permitted certain immigrant students who have grown up in the U.S. to apply for temporary legal status, eventually obtain permanent legal status, and become eligible for U.S. citizenship if they go to college or serve in the U.S. military. The DREAM Act has failed repeatedly to pass Congress. The DREAM Act initially could provide amnesty for <a href="http://www.cis.org/dream-act-costs">over one million illegal immigrants</a> and would have cost over $6 billion a year.</p>
<p>Highlights from the newly disclosed documents include the following:</p>
<ul>
<li>In an April 20, 2010, <a href="https://www.judicialwatch.org/files/documents/2011/dhs-dream-act-docs-07232011-4.pdf#page=199">email from Melissa Crow, former DHS Acting Deputy Assistant Secretary for Policy in the Office of Immigration and Border Security, to Roxana Bacon, Chief Counsel for the U.S. Citizenship and Immigration Services (USCIS)</a>, Crow states: “Since we met, I’ve done my best to encourage ICE to grant deferred action in the DREAM Act cases…brought to my attention.”</li>
<li>In an email chain about “one of the DREAM [Act] kids” who was being detained by authorities suggests confusion at DHS regarding how to handle requests for “deferred action” from illegal alien students. In the email chain, <a href="https://www.judicialwatch.org/files/documents/2011/dhs-dream-act-docs-07232011-1.pdf#page120">ICE (U.S. Immigration and Customs Enforcement) Chief of Staff Suzanne Barr writes to DHS Deputy Press Secretary Matthew Chandler</a>, “we r f’ed up,” to which Chandler responds, “Yep. And we wonder why pp’l FOIA us.” The student was granted a <em>stay of removal</em> for six months.</li>
<li>In response to a <em>USA Today</em> inquiry into whether aliens are required to carry identification, <a href="https://www.judicialwatch.org/files/documents/2011/dhs-dream-act-docs-07232011-1.pdf#page=163">DHS General Counsel John R. Sandweg writes</a>, “Ugh. Yes. Fed law does require aliens to carry their paperwork. I don’t know if it is a criminal offense, but this provision has gone relatively unnoticed by media and [redacted].” “…I think some groups of aliens are exempted from this requirement as they don’t really have paperwork (folks who were issued deferred action). Either way, it is not routinely enforced.”</li>
<li>In a <a href="https://www.judicialwatch.org/files/documents/2011/dhs-dream-act-docs-07232011-3.pdf#page=168">memo from Mariela Melero, Chief of the Office of Public Engagement of U.S. Citizenship and Immigration Services (USCIS) to USCIS Director Alejandro Mayorkas</a>, entitled “Stakeholder Input of Administrative Reforms,” Melero sets forth suggested reforms “outside of Comprehensive Immigration Reform,” which includes the opinion that the director &ndash; unless otherwise required by law &ndash; has the authority to judge if the evidence presented for deferred action is “probably true.” <a href="https://www.judicialwatch.org/files/documents/2011/dhs-dream-act-docs-07232011-3.pdf#page170">Another reform</a> would allow a 501(c)3 organization in “good standing… to design and implement voter registration programs at USCIS offices across the country.”</li>
</ul>
<p>The Obama administration’s campaign to suspend the deportations of illegal aliens has been subject to intense scrutiny since 2010, when the press uncovered a USCIS memo that contemplated various “administrative alternatives” to bypass Congress and implement stealth amnesty for illegal aliens. A subsequent <em>Houston Chronicle</em> story exposed an effort by the administration to suspend the deportations of illegal aliens who supposedly have not been convicted of any “serious” crimes. Documents uncovered by Judicial Watch show that DHS officials misled Congress and the public about the scope of the immigration enforcement policy change, which gave wide latitude to local immigration officials to dismiss illegal alien deportation cases – including the dismissal of charges against illegal alien criminals <a href="https://www.judicialwatch.org/files/documents/2011/dhs-houston-amnesty-docs-2.pdf">convicted</a> of violent crimes. The Obama administration announced last week that it would effectively halt any enforcement actions (on an alleged “case-by-case” basis) against any illegal alien who hasn’t committed any other serious crimes. The administration denied that this was a blanket or categorical amnesty, but these new documents show otherwise.</p>
<p>“These documents show the Obama administration is lying about its stealth amnesty activities and its alarming contempt for Congress and the rule of law. Frankly, these documents show that Obama immigration officials don’t even know what the law is! The Obama administration cannot simply pick and choose which federal immigration laws it will enforce. <div>Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it <a class="scribd" href="http://www.scribd.com/fullscreen/69610078?access_key=key-ud6vkkhefgr3x6freas">filed a Freedom of Information Act (FOIA) lawsuit</a> on April 14, 2011, against the Department of Homeland Security (DHS) to obtain records detailing Homeland Security’s investigation of Carlos Martinelly-Montano, an illegal alien who allegedly struck and killed a Virginia Benedictine nun in a drunk driving accident on August 1, 2010. Judicial Watch obtained an internal DHS report on the Martinelly-Montano investigation in response to a previous lawsuit. Judicial Watch now seeks all communications between the DHS and the Obama White House, as well as internal DHS records regarding the investigation and the report (<em><a href="https://www.judicialwatch.org/judicial-watch-v-u-s-department-homeland-security-9">Judicial Watch v. U.S. Department of Homeland Security</a></em> (Case No. 11-725)).</div>
<div>On February 16, 2011, Judicial Watch sent an FOIA request to the DHS seeking access to the following:</p>
<ul>
<li>Any and all records of communications, contacts, or correspondence with the White House and/or Executive Office of the President concerning a report/memorandum prepared at the direction of the United States Secretary of Homeland Security, Janet Napolitano, related to Carlos Martinelly-Montano, an unlawfully present alien charged with killing a Benedictine nun and injuring two others in a August 2010 drunk driving incident in Prince William County, Virginia for the period of October 1, 2010 through February 15, 2011.</li>
<li>Any and all records of communications, contacts, or correspondence within the Department of Homeland Security concerning a report/memorandum prepared at the direction of the Unite States Secretary for Homeland Security, Janet Napolitano, related to Carlos Martinelly-Mantano for the period of October 1, 2010 through February 15, 2011.</li>
</ul>
<p>In a letter dated February 24, 2011, DHS acknowledged that it received Judicial Watch’s request on February 17, 2011. DHS was required to respond by March 17, 2011. However, to date, DHS has failed to produce responsive documents or indicate when a response is forthcoming.On March 3, 2011, Judicial Watch obtained an <a class="scribd" href="http://www.scribd.com/fullscreen/69609728?access_key=key-2hkuqudh1ht55mkxajcp">edited “final” DHS report</a> detailing the agency’s investigation of Martinelly-Montano. DHS had promised a federal court that it would release the report earlier in the year, but afterward claimed that the document was in “draft” form and therefore would not be released. The final report is curiously dated November 24, 2010. It details the policies and actions of the Obama administration and local governments that allowed Montano, an illegal alien who committed a series of crimes, to remain on the streets despite being subject to deportation. Specifically, the report confirms that the Obama administration decided to not detain the illegal alien after he served his jail sentence for other offenses, and to release him onto the streets.“The suspicious manner in which the DHS handled the release of this report merits further investigation. There is no question the ‘final’ report released to the public was edited and polished by DHS, and it smacks of a cover-up. The American people deserve to know who was involved and what information was withheld,” said Judicial Watch President Tom Fitton. “Even in its edited form, this report is an indictment of the Obama administration’s lax approach to illegal immigration enforcement. Illegal alien sanctuary policies almost certainly led to the release of Martinelly-Montano and subsequently to the death of Sister Denise Mosier.”Carlos Martinelly-Montano, who entered the country illegally as a child from Bolivia, is charged with killing Sister Denise Mosier and critically injuring two other nuns while driving drunk in Prince William County, Virginia. He has been charged with involuntary manslaughter and drunk driving. Martinelly-Montano had previously been arrested in October 2008 for another drunk driving incident and was placed in the custody of U.S. Immigration and Customs Enforcement (ICE). Though he was scheduled for deportation, his hearing was delayed three times, and deportation never occurred.</div>

US Department of Homeland Security</a></em> (No. 11-604) and <em><a href="https://www.judicialwatch.org/files/documents/2011/jw-v-dhs-complaint-11-606-03232011.pdf">Judicial Watch v. US Department of Homeland Security</a></em> (No. 11-606)).</div>
<div>On July 2, 2010, Judicial Watch sent a FOIA request to DHS seeking the following information: “Any and all records of communications between the Department of Homeland Security and any of the following entities, concerning ‘deferred action’ or ‘parole’ to suspend removal proceedings against a particular individual or group of individuals for a specific timeframe; as well as records of communications concerning ‘selective reprieve’ to the segment of the population holding expired visas: The White House; The Executive Office of the President; Any third parties.” Judicial Watch sought internal DHS communications regarding “deferred action or parole” as well.On August 30, 2010, Judicial Watch submitted a FOIA request to DHS seeking the following information:</p>
<ul>
<li>Any and all records of, and/or records concerning, Department of Homeland Security briefings regarding a systematic review of pending immigration cases against suspected illegal immigrants in Houston, Texas.</li>
<li>Any and all records of general guidelines issued to Department of Homeland Security attorneys, allowing dismissal of pending immigration cases.</li>
<li>Any and all records detailing the determination and implementation of a systematic review of pending immigration cases against suspected illegal immigrants in Houston, Texas.</li>
<li>Any and all correspondence with non-governmental organizations…concerning the process for US Immigration and Customs Enforcement to give consideration of possible dismissal of pending immigration cases.</li>

<p>DHS acknowledged receipt of Judicial Watch’s FOIA requests. However, to date, the agency has failed to provide responsive documents. DHS has not indicated when a response will be forthcoming. In both cases, DHS has failed to respond in the statutory allotted timeframe precipitating Judicial Watch’s lawsuits. (Reporting by <em><a href="http://hosted2.ap.org/APDEFAULT/index.ssf/Article_2011-03-28-US-Freedom-of-Information/id-667d91705f3d4cefbddc7431745ae46c" target="_blank">The Associated Press</a> </em>suggests that DHS political appointees have improperly delayed FOIA requests on politically sensitive topics.)The Obama administration has been heavily criticized for their alleged plan to bypass Congress and enact “stealth amnesty.” In June 2010, the press uncovered a U.S. Citizenship and Immigration Service “draft” memo that outlined ways to grant legalization to illegal aliens without going through Congress.The August 24, 2010, edition of <em><a href="http://www.chron.com/disp/story.mpl/special/immigration/7169978.html" target="_blank">The Houston Chronicle</a></em> reported the government had already put one such plan into action: “The Department of Homeland Security is systematically reviewing thousands of pending immigration cases and moving to dismiss those filed against suspected illegal immigrants who have no serious criminal records…Culling the immigration court system dockets of noncriminals started in earnest in Houston about a month ago and has stunned local immigration attorneys, who have reported coming to court anticipating clients’ deportations only to learn that the government was dismissing the cases.”Despite evidence to the contrary, <a href="http://www.washingtontimes.com/news/2011/mar/28/obama-rules-out-back-door-legalization-of-immigran/" target="_blank">Obama claimed</a> on Monday, March 28, 2011, that he does not have a plan in place to suspend deportations. “There are enough laws on the books by Congress that are very clear in terms of how we have to enforce our immigration system that for me to simply, through executive order, ignore those congressional mandates would not conform with my appropriate role as president,” Obama said.“President Obama may deny he has a plan to suspend deportations but the experience of immigration attorneys in Houston suggests otherwise. That’s why it’s critical that Homeland Security follows the open records FOIA law and turns over these records. The American people need to know if the Obama administration has decided to flout our immigration laws and enact stealth amnesty for illegal aliens who are unlawfully here in the United States. <blockquote><p>“On December 7, 2007, Montano was convicted for driving under the influence (DUI) in Prince William County, Virginia and was sentenced to serve 30 days of incarceration. The judge in Prince William County, however, suspended all 30 days of the jail sentence with the result that Montano was not jailed for his offense. Local authorities did not seek to determine Montano’s immigration status nor did they contact ICE (Immigration and Customs Enforcement).”“Almost one year later, on October 4, 2008, Montano was booked into jail in Prince William County and charged with another misdemeanor DUI. At the time of this arrest, the local authorities determined that Montano was an illegal alien. Thus, ICE lodged an immigration detainer against him. As a result of the immigration detainer, immigration officers took him into custody. On October 7, 2008, Prince William County officials released him from custody.”Rather than detaining Montano, “ICE agents determined that Montano was a candidate for the Alternatives to Detention (ATD) program,” which monitored his whereabouts using GPS technology. He was therefore released.While awaiting his deportation hearing, “Montano was charged on March 5, 2009, in Fairfax County, Virginia, with misdemeanor failure to appear related to driving without a license. Local officials dismissed this charge against Montano on May 5, 2009. County officials did not contact ICE. On April 27, 2010, a Manassas Park police officer cited Montano for misdemeanor reckless driving. There is no record indicating that Montano was booked or fingerprinted or that Manassas Park officials contacted ICE. On June 1, 2010, Montano was convicted for reckless driving and fined $500. Again, ICE was not contacted following the citation or conviction.”“On April 27, 2009, as a result of the October 2008 DUI arrest, the Circuit Court of Prince William County convicted Montano and sentenced him to serve 12 months and 3 days in jail. However, the judge in Prince William County suspended 11 months and 13 days of Montano’s sentence. As a result of the judge’s decision, Montano served less than two weeks in Prince William County for his second DUI conviction.”“On May 7, 2009, after Montano served the portion of his sentence that had not been suspended, ICE took him into custody. Based on Montano’s compliance during his prior participation in the ATD program, ICE officers released Montano on the prior order of supervision (dating back to 2008) with the condition that he report to ICE on a regular basis.”</p></blockquote>
<p>Decisions by the Executive Office for Immigration Review caused delays in the removal proceedings. Moreover, Montano’s immigration attorney successfully convinced an immigration judge to delay Montano’s removal hearing on two occasions. The court ultimately scheduled Montano’s hearing for August 19, 2010. However, on August 1, 2010, while under the influence of alcohol, Montano was charged with crashing his car into another vehicle, killing one nun and critically injuring two others.With respect to the decision to release Montano, rather than detaining him, the report concludes: “In 2008, when the decision was made to release Montano, fewer beds were available in the Washington, D.C. metropolitan area.” The report also points to government policies that allowed immigration officials “broad discretion” about how to use detention resources. <div><strong></strong>Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that the Obama administration broke a promise made to a federal court to release an internal memo detailing its investigation of an illegal alien who killed a Virginia nun in a drunk driving accident in August 2010. Judicial Watch filed a <a href="https://www.judicialwatch.org/judicial-watch-v-u-s-department-homeland-security-6">Freedom of Information Act (FOIA) lawsuit</a> to obtain the report. The Department of Homeland Security (DHS) then told a federal court that the report would be released by January 18, 2011. However, the Obama administration now <a href="http://www.scribd.com/fullscreen/70691460?access_key=key-2hiiscf1dzbv5s6omf5j">claims that the report is still in “draft” form</a> and is therefore exempt from FOIA.</div>
<div>On January 6, 2011, Judicial Watch received the following message in an email from the Assistant U.S. Attorney (AUSA) assigned to Judicial Watch’s FOIA lawsuit: “I have discussed this matter with the agency and have been advised that the requested report/memorandum has been processed and will be disclosed subject to redaction of certain personal/privacy information under FOIA Exemptions 6/7C. The agency hopes to disclose the material by January 18, 2011. Accordingly, you will receive and have an opportunity to review the release during the requested 30-day extension period. We can then discuss what, if anything, remains of the case.”Indeed, in <a href="http://www.scribd.com/fullscreen/69610088?access_key=key-10rv9ejnt7y9liva6hr9">seeking court permission on January 13 to get more time</a> to answer Judicial Watch’s lawsuit, the agency likewise told the court (The Honorable Emmet G. Sullivan) that “the report memorandum…has been promised and will be disclosed subject to redaction of certain personal privacy information.” The agency told Judicial Watch that it hoped to “disclose the material in the next week and believed the anticipated disclosure will moot the lawsuit.” Based upon this representation, Judicial Watch did not oppose the request for more time. The Court, also relying on this representation that the report was set to be released in a week, granted the Obama administration’s request for more time.However, following multiple attempts by Judicial Watch’s litigation team to obtain an update on the release of the report, Judicial Watch received the following email from the same Homeland Security AUSA on January 28: “The agency has advised of a delay in the release of the requested report…ICE [Immigration and Customs Enforcement] clarifies that the current version of the report is still in draft form and that, while the final report will be released, Exemption 5 (deliberative process) will likely be asserted as to the draft report.” A subsequent email from DHS noted that ICE “cannot provide a specific release date at this time” for the final report.On February 11, 2011, Judicial Watch <a href="http://www.scribd.com/fullscreen/70691460?access_key=key-2hiiscf1dzbv5s6omf5j">received a letter from ICE FOIA officer Catrina M. Pavlik-Keenan</a> confirming the fact that the report will not be released as promised: “After review of the draft document, I have determined that this draft document will be withheld in its entirety pursuant to Exemption 5 of the FOIA.”Montano, a Bolivian national who entered the country illegally as a child, killed Sister Denise Mosier and critically injured two other nuns while driving drunk on August 1, 2010, in Prince William County, Virginia. He has been charged with involuntary manslaughter and drunken driving. Montano had been arrested on two prior drunk driving charges. He was placed in the custody of federal immigration officials in 2008 and was scheduled for deportation, but was released on his own recognizance pending a deportation hearing that never took place.Homeland Security Secretary Janet Napolitano ordered an investigation on August 2, 2010, to determine why Montano’s removal process took so long. However, Homeland Security initially refused to release its report documenting the results prompting Judicial Watch to file its FOIA lawsuit on December 2, 2010.Here we have yet another broken promise on transparency by the super-secretive Obama administration. One can draw a conclusion, an almost inescapable one, that the DHS report on the illegal alien nun-killer contained damaging revelations, so now Obama appointees are scrubbing the report. As the report supposedly went to Secretary Napolitano, this scandal seems to go to the top. I think we have a cover-up in the making. Judicial Watch, for its part, will continue to fight in court for the immediate release of the report,” stated Judicial Watch President Tom Fitton.</div>
