Grassroots Public Interest Groups Seek Court Permission to Intervene to Defend Florida Clean-up Efforts: ‘…not only are the State of Florida’s list maintenance activities valid, proper, and timely, but… they are also required under federal law.’

(Washington, DC) – Judicial Watch, the public interest group that investigates and fights government corruption, announced today that it has filed a Motion for Intervention with its client True the Vote to defend the State of Florida’s efforts to clean up voter registration lists against an Obama administration lawsuit (The United States of America v. State of Florida and Ken Detzner (No. 4:12-cv-285)).

Florida initiated a systematic effort to remove ineligible voters from its voter registration lists after Judicial Watch filed a letter of inquiry with Florida election officials on February 6, 2012.

Judicial Watch alerted the State of Florida that failure to maintain clean voter registration lists violates Section 8 of the National Voter Registration Act (NVRA). In response to Florida’s efforts to comply with the NVRA, the Obama administration filed a lawsuit on June 12, 2012, asking a federal court to enjoin the state from continuing its purge of illegal voters.

According to Judicial Watch’s motion, filed jointly with Judicial Watch client True the Vote on June 26, 2012, with the United States District Court for the Northern District of Florida, Tallahassee Division:

[Judicial Watch and True the Vote] seek to enter this lawsuit in order to demonstrate that, not only are the State of Florida’s list maintenance activities valid, proper, and timely, but that they also are required under federal law. Intervention will ensure that the organizational interests of Proposed Intervener True the Vote and the rights and interest of the members of Proposed Intervener Judicial Watch, Inc. are adequately protected and preserved.

As reported by The Associated Press, the State of Florida ordered the removal of 53,000 dead voters from its lists while identifying an additional 2,700 non-citizens registered to vote. Press reports suggest the number of non-citizen voters in the state could be as high as 180,000.

Judicial Watch’s actions in Florida are part of its 2012 Election Integrity Project. According to a comprehensive Judicial Watch investigation, in addition to Florida and Indiana, a number of other states also appear to have problems with inaccurate voter registration lists, including: Mississippi, Iowa, Missouri, Texas, Ohio, Pennsylvania, West Virginia, Alabama, and California. Judicial Watch has put election officials on notice in these states that they must maintain accurate voter registration lists consistent with Section 8 of the NVRA or face litigation to enforce the federal law.

On June 11, 2012, Judicial Watch (along with co-plaintiff True the Vote) filed a federal lawsuit against the State of Indiana for failure to comply with voter list maintenance provisions of the NVRA. J. Christian Adams, a former civil rights attorney with the Department of Justice, is of counsel to the groups on these legal actions. The groups are also represented in Florida by the firm, Radey, Thomas, Yon & Clark.

“The Obama Justice Department is evidently hostile to the idea of clean and fair elections,” said Judicial Watch President Tom Fitton. “It is shameful that the Justice Department is now in court trying to stop Florida from fulfilling its legal obligation to remove non-citizen, ineligible voters from the voting rolls. We look forward to defending the voting rights of our supporters, the rule of law, and election integrity from an unprecedented attack from this politicized Justice Department.”

“According to polls, most Americans agree that Florida should be making efforts to ensure people who are not eligible to vote are kept off of the voter registration rolls. Not only is this common sense, it is what the law requires. It’s disappointing that the Justice Department is more interested in taking extreme legal positions than protecting the integrity of the 2012 elections,” said True the Vote President Catherine Engelbrecht.

A recent report by non-partisan Pew Charitable Trusts (Pew) published in February 2012 indicates that approximately 24 million active voter registrations in states across the country – or one out of every eight registrations – are either no longer valid or are significantly inaccurate.

Florida legislators are under attack from a terrorist front group for considering a bill aimed at banning the application of Sharia law—the authoritarian doctrine that inspires Islamists and their jihadism—from courtrooms throughout the state.

Though it really targets Sharia, the measure seeks to prohibit the application of any foreign law, code or system in legal cases, especially in family court. It was introduced after a state appeals court allowed a county judge in central Florida to consider “ecclesiastical Islamic law” to decide a civil case involving a mosque.

As a Florida state House committee considers the bill this week, the Council on American Islamic Relations (CAIR), a national organization that serves as the U.S. front for the Palestinian terrorist group Hamas, is blasting it as an attempt to “demonize Islam and marginalize Muslims.” If the measure passes it will also restrict religious freedom, according to CAIR.

A few years ago CAIR pressured a south Florida county’s transit agency to drop bus advertisements considered by the group to be “misleading and bigoted” against Muslims. CAIR asserted that the ads created a campaign of hatred and intolerance because they gave the false impression that Muslims are “trapped” in their religion with no means of “escape,” thus facing certain death.

CAIR bills itself as a Muslim civil rights organization but top FBI counter terrorism chiefs describe it as an entity that promotes and finances terrorism. One group has dedicated itself to documenting CAIR’s extensive terrorist ties which include a top official sentenced to 20 years in prison for participating in a network of militant jihadists, another convicted of bank fraud for financing a major terrorist group, a board member who was a co-conspirator in the 1993 World Trade Center bombing and a fundraiser identified by the U.S. Treasury Department for financing Al Qaida.

Getting back to Sharia law, accomplished military, terrorism and national security experts have long asserted that terrorists are covertly using it as a non-violent way to destroy the United States. Some, including former CIA Director Jim Woolsey, appeared in a Washington D.C. seminar (The Sharia Challenge in the West) last year at the Conservative Political Action Conference.

A foreign policy specialist who has worked for both Democratic and Republican administrations, Woolsey defines Sharia as a “theocratic dictatorship extremely opposed to democracy” and a movement to “eliminate and destroy western civilization.” He warns that the biggest challenge in fighting it is America’s long tradition of tolerance towards all religions.

An ethics complaint has been filed against Florida’s new governor, Rick Scott, for abusing the power of his office to financially benefit a chain of medical clinics that represent the single biggest chunk of his vast fortune.Scott, who was embroiled in a federal fraud investigation before moving into the governor’s mansion earlier this year, assures there is no conflict because his wife controls his $62 million investment in the walk-in clinics. A few days before taking office in January, Scott transferred his shares to his wife precisely to avoid any conflict of interest. Here is where it gets a little hairy for the Republican lawmaker who never held public office before this year. The healthcare policies he’s pushing would translate into hefty profits for hisFlorida chain of 32 urgent-care centers known as Solantic Corp. Scott co-founded Solantic in 2001 and was involved in its operation until last year, according to the newspaper story that connected the dots this month.Concentrated in the middle part of the state and along the east coast, Solantic clinics provide the medical version of one-stop shopping. Patients can get stitches, physicals and immunizations or they can receive treatment for a sprain or virus. The drug testing of all state workers, switching Medicaid patients to private Health Maintenance Organizations and downsizing public clinics that Scott is pushing will likely benefit Solantic.Another area of concern is that, as governor, Scott appoints the officials who head the state agencies that license, inspect and investigate complaints against healthcare providers such as Solantic. The woman who co-founded Solantic with Scott, chief executive Karen Bowling, dismisses the possibility that state regulators will be influenced by Scott and says inspection complaints are handled under a formal and public process anyways.Incredibly, Florida has no provisions banning elected officials from promoting policies that financially benefit family. Considering Scott’s past, this should be unsettling to residents of theSunshine State. After all, he was ousted as chief executive of a major hospital chain amid a huge federal billing fraud investigation that cost the company $1.7 billion in penalties. Scott walked away with $10 million in severance and $300 million in stock, part of which he used to start Solantic.
