USA v. The State of Arizona (No. 10-cv-01413-SRB) – intervening on behalf of State Senator Russell Pearce in defense of SB 1070

Synopsis

On April 23, 2010, Arizona Governor Jan Brewer signed into law legislation authored by State Sen. Russell Pearce that, among other provisions, makes it a crime to be in the State of Arizona without proper documentation. The language of the law was crafted so that it would be entirely consistent with federal law. However, on July 6, the Obama Justice Department filed a lawsuit challenging the law and requesting a preliminary in junction preventing the law from being enforced. On July 15, Judicial Watch filed a “Motion to Intervene” on behalf of Sen. Pearce, and we will be representing him in an effort to defend the Arizona law. On February 11, 2011, Judicial Watch filed a “Motion to Intervene” on behalf of the entire Arizona State Legislature.
