Dear Messers Orfanedes and Fedeli,
Enclosed please fmd documents responsive part your March 20,2012, FOIA
request. These records were located result search conducted the Commander, Naval
Air Force, U.S. Pacific Fleet (COMNAVAIRPAC).
The documents consist emails (31 pages) found the course the
COMNAV AIRPAC search. Those emails have been reviewed and determined partially
releasable. Certain information being withheld within the documents currently and properly
classified pursuant Executive Order 13526, 1.4(a) concerning military plans, weapons
systems, operations; 1.4 (c) concerning intelligence activities (including covert action) and
intelligence sources methods; and 1.4(d) concerning foreign relations foreign activities
the United States, including confidential sources. Information also exempt statute
establishing particular criteria for withholding; specifically U.S.C. 130(b), which permits
the withholding information about personnel overseas routinely deployable and sensitive
units. addition, some the withheld information exempt from release pursuant the
deliberative process privilege. Some information withheld because its release would constitute clearly unwarranted invasion the personal privacy individuals. Consequently, must deny
this information pursuant U.S.C. 552(b)(1), (b)(3), (b)(5), and (b)(6).
Additionally, the COMNAVAIRP has informed this office that after careful search their records, they have found records responsive part your request. addition, the
commanding officer the USS VINSON the time the burial sea confirmed that his
knowledge, such records exist the possession control ofthe VINSON, COMNAV AIR, the U.S. Navy. Since this request litigation, all apellate rights are moot.
