Mr. WELDON Pennsylvania. Mr. Speaker, rise tonight talk our colleagues and through our 
colleagues the American people about issue that troubles greatly. have been this institution years, and during those years have been the Committee Armed Services. Currently, the vice chairman that committee and chairman the subcommittee that oversees the purchase our weapons systems. the past have chaired the research subcommittee. have chaired the readiness subcommittee, and have spent every available hour time working make sure that our military troops were properly protected and have the proper equipment and training. strong supporter our military. Whether was the last years the Reagan administration,

strong supporter President Bush. campaigned for him. strong supporter Secretary 
Rumsfeld. say all that, Mr. Speaker, because tonight rise express iny absolute outrage and 
disgust with what happening our defense intelligence agencies. 
Mr. Speaker, back 1999 when was Chair the defense research subcommittee, the Army was doing cutting-edge work new type technology allow understand and predict emerging transnational terrorist threats. That technology was being done several locations, but was being led our Special Forces Command. The work that they were doing was llilprecedented. And because what saw there, supported the development national capability collaborative center that the CIA would just not accept. fact, November 4of 1999, years before 9/11, meeting office with the Deputy Secretary Defense, Deputy Director the CIA, Deputy Director the fBI, presented nine-page proposal create national collaborative center. When finished the brief, the CIA said did not need that 
capability, and before 9/11 did not have it. 
When President Bush came after year research, announced the formation the Terrorism

before 9/11 every happened. addition, learned that not only did identify the Brooklyn cell 
Qaeda, but identified Mohamed Atta one the members that Brooklyn cell along with three 
other terrorists who were the leadership the 9/11 attack. have also learned, Mr. Speaker, that September 2000, again, over year before 9/11, that Able Danger team attempted three.separate occasions provide information the FBI about the Brooklyn cell Qaeda, and three separate occasions they were denied lawyers the previous administration transfer that information. 
Mr. Speaker; this past Sunday "Meet the Press," Louis Freeh, FBI Director the time, was 
interviewed Tim Russert. The first question Louis Freeh was regard the FBI' ability ferret out the terrorists. Louis Freeh's response, which can obtained anyone this country part the official record, was, Well, Tim, are now finding out that top-secret program the military called Able Danger actually identified the Brooklyn cell Qaeda and Mohammed Atta over year before 9/11.

But, you see, Mr. Speaker, there problem. The Deputy Director the Defense Intelligence Agency was meeting with Lieutenant Colonel Shaffer almost year before 9/11, and Lieutenant Colonel Shaff showed him disk his office with information about Qaeda and Mohammed Atta, and the Deputy Director the Defense Intelligence Agency stopped the briefing and said, you cannot show that. not want see it. might contain information cannot look at. 
Now, Tony Shaffer was not the room alone, Mr. Speaker. There were other people, and know their names. have witnesses. Now, the Deputy Director has denied that meeting and denied was there and denied this particular story, but the fact knows that are going pursue it. what has happened Lieutenant Colonel Shaffer, Mr. Speaker? The Defense Intelligence Agency has lifted his security clearance. One day before was testify before the Senate Committee the 

Judiciary, uniform, they permanently removed his security clearance. And now our Defense Intelligence Agency has told Colonel Shaffer's lawyer that they plan seek permanent removal his pay and his health care benefits for him and his two children. Why, Mr. Speaker? Becaus Lieutenant 

Colonel Shaffer, like Commander Scott Philpot the Navy, like Smith, and like host other Able Danger employees, has told the truth. 
Now, Mr. Speaker, sat here the 1990s and sat here during the 9/11 investigation and watched 
ridiculous situation develop with Sandy Berger, the National Security Adviser under President Clinton. walked into the National Archives before was testify before the 9/11 Commission looking through documents. took documents out the archives and stuffed them his socks and pants 
that one would see them left the National Archives. Now, that felony, tampering with Federal documents and removing classified information regarding our security and information that the 9/11 commission needed see. 
Sandy Berger initially lied about it. said did not do it. Then admitted it, and was given punishment. And, oh, the way, his security clearance was temporarily lifted, but will get back again, for lying, for stealing, and for committing act outrage against our country's security. Lieutenant Colonel' Shaffer; Bronze Star 23year military veteran, simply told the truth and now his life being ruined. 
His career ended. longer military intelligence. 'They have taken his security clearance, and they are about destroy him person. They are about deny him the basic health care and the salary that has earned, and they are doing this way. This outrageous. evil. They not want fire Tony because they also not want him talk the media. suspending him and removing his pay and his health care, they hurt him bad, but cannot talk because under suspension and his 

lawyer has advised him that talk the media, talk Members Congress, even when not being paid, would cause him further problems and totally prevent him from ever having this gross problem reversed. Mr. Speaker, this outrageous. Mr. Speaker, this not America. 

Over years Congress, have led delegations the former Soviet Union. have sat the face the Soviet Communists and confronted them full transparency. sat the table with President Lukashenko Belarus, who has been called our Secretary State the lst dictator Europe. took both delegations North Korea, Mr. Speaker, and sat across the table from Kim Gye Gwan and told him abhor the way they treat their people, the way they lie about what happening, and the way they distort information.

You know, Mr. Speaker, never thought would have take the floor this Chamber and make the same statements about the Defense Intelligence Agency. supporter the President, supporter the military, Mr. Speaker, allow this forward, then send the signal every man and woman wearing uniform that you tell the truth, you will destroyed career bureaucrat above you does not like what you are saying. you tell the truth, will take your health care benefits away 

from your kids. you tell the truth, will ruin you. 
Mr. Speaker, this not America. Mr. Speaker, this not what have been told Secretary Rumsfeld that are doing with our troops protecting them, giving them the best equipment and the best training. This not what spend hours committee hearings on. 'Ihls sends the wrong sigr;i.al America's troops. tells them, not honest. not respect the fact that you have truthful.

Mr. Speaker, have today asked for independent investigation the Dfense Intelligence Agency and their efforts destroying Tony Shaffer's life. This outrageous, Mr. Speaker. They trumped charges against him. They said while was overseas Afghanistan, forward deployed, that forwarded cell phone calls from his official phone his personal phone; and when they checked that out, ran cost the taxpayers about $60. The sec.and verbal charge they gave 
him was that went course the Anny War College and he.got reimbursed for his travel, his mileage and tolls, 100-some dollars. And they said received commendation for which was not entitled, even though was signed his c.ommanding officer and the acting Secretary the Anny. 
But they went beyond that, Mr. Speaker. They went beyond that with this man. They said had $2,000 debt, personal debt. Well, would like have every Pentagon_ employee tomorrow, would like have the senior leadership show what debt they have the Defense Intelligence Agency can make that public. 

They even went this length, Mr. Speaker: the Defense Intelligence Agency wrote official 
document that Lieutenant Colonel Shaffer stole public property. serious charge. Well, when you check 
what that public property was, was assortment pens, government pens. But what they did not say the Defense Intelligence report was that took those pens when was years age and was with 
his father when was assignment one our embassy outposts. took the pens give other 
students the school when was years age. And the way, Mr. Speaker, was Tony Shaffer 
himself who admitted that thievery when applied for his security clearance. the Defense 
Intelligence Agency knew that during his entire career years, but they put that the document 
against him. 

This scandal, Mr. Speaker. outrage. travesty. Everyone that worked with Tony Shaffer, the Navy officers, the private citizens have all said the same thing. This scandal get Tony Shaffer because has told the truth. 
Now, this Defense Intelligence Agency and this Deputy Director had the audacity have their legal 
counsel send Tony Shaffer's lawyer letter September 23. cannot put that letter the RECORD 
because privileged information, but will eventually come out. But that letter, the second 

 
1ast paragraph, the legal counsel for the Defense Intelligence Agency says Mr. Shaffer's lawyer, cannot receive any more classified information from the Defense Intelligence Agency because checked and his security clearances have all been removed: Therefore, not allowed look anything that secret confidential. 
Now, that letter sent the general counsel the DIA September this year. Two weeks later, Mr. Speaker, show the stupidity the Defense Intelligence Agency, they send seven packages Mr. Shaffer's lawyer his personal belongings, which the Deputy Director the DIA told staff months ago did not exist any more. And those seven boxes, Mr. Speaker, were five classified memos. The Defens.e Intelligence Agency sent :five classified memos Lieutenant Colonel Shaffer, which they told him September was not allowed have access to.

Mr. Speaker, that felony; and have asked the Inspector General and the legal officials investigate and prosecute the Defense Intelligence officials who sent five classified documents through the mail hand delivery Tony Shaffer. addition, Mr. Speaker, the Defense Intelligence Agency, its abso1ute total stupidity, included those boxes $500 worth Federal property, including multi-hundred dollar GPS system owned the Federal Government, which they sent Tony Shaffer, guess keep. They also sent, Mr. Speaker, pens, brand new, and marked them "Property the U.S. Government." The Defense Intelligence 

Agency, its absolute utter stupidity, sent Tony Shaffer Federal property which they accused him taking when was years age. 
Mr. Speaker, there something desperately wrong here. There bureaucracy the Defense Intelligence Agency that out control. They want destroy the reputation 23-year military officer, Bronze Star recipient, hero our country, with two kids because people defense intelligence are embarrassed what going come out. 

And what going come out, Mr. Speaker? Well, are going find out, Mr. Speaker, that that unit, Able Danger, not only identi fied Mohammed Atta before 9/11, not only did they try pass that information the FBI, not only was that large data destroyed the summer 2000, but now, Mr. Speaker, can add new dimension this whole story. Yesterday, Mr. Speaker, met with another Able Danger official. was not aware this official's knowledge because does notlive within the Beltway. 

This official, Mr. 
Speaker, has impeccable credentials. cannot reveal his name today. will any Member ofthis body, any our colleagues that want come me, will tell you privately who this official is, and you will agree with when tell you his name that has impeccable credentials. This official yesterday, Mr. Speaker, meeting office, told that has never been talked the 
Pentagon. has never been talked the Defense Intelligence Agency their supposed investigation. has never been talked the 9/11 Commission staff their investigation; yet this official had leadership position Able Danger. 
This official told that there separate cache ofinformation collected from over Federal agencies 1999 and 2000 Able Danger that still may exist. Now, the Pentagon has told all this material was destroyed, and now have senior official telling there second pot information that may well still exist. 

Furthermore, the hearing over the Senate Committee the Judiciary, when Senator Specter asked why this data was destroyed, the witness who destroyed the data said, well, was told that could not keep this data for more than days because might involve information that contains U.S. persons, had destroy it. 2045 
Well, found out that not the story, The reason the data was destroyed was because Special Forces Command asked the Anny for that data and within matter days, that data was destroyed the Anny would not pass Special Forces Command. Yet there still is, was and hope still massive pot 
 
data. 

But furthermore, that official that talked yesterday will also say that there was 90-day requirement, was testi fied before the Senate Committee the Judiciary. said regular basis they kept information from Able Danger data mining for months and months and months. fact, will say had discussion with lawyer DOD named Scbiffren who told him not worry about it, just 
fill out document, sign your name that you need it, put the box, and you can keep long you want. 

Mr. Spea
