REFERENCES: EXECUTIVE ORDER 12333 DODD 5240.1 DODD 5200.27 DOD REG 5240.1-R MGM 75-91 381-10 SECNAVINST 3820.3D AFI 14-104 MCO 3800.2A DIRECTOR COUNTERINTELLIGENCE MEMO, "AUTHORITY COLLECT INFORMATION DOMESTIC TERRORIST AND OTHER GROUPS COMMITTING ILLEGAL ACTS THAT POSE THREAT THE DEPARTMENT DEFENSE (U),'' DATED JAN 98. 
THE PURPOSE THIS MESSAGE PROVIDE POLICY GUIDANCE COMMANDERS AND SUPPORTING DODO INTELLIGENCE ORGANIZATIONS REGARDING PERMISSIBLE INTELLIGENCE SUPPORT FOR FORCE PROTECTION ACTIVITIES. 
THIS MESSAGE HAS BEEN COORDINATED WITH THE JOINT STAFFF; THE DOD GENERAL COUNSEL; THE INSPECTOR GENERAL, DOD; THE UNDERSECRETARY DEFENSE FOR POLICY; AND THE SENIOR CIVILIAN OFFICIAL THE OFFICE THE ASSISTANT SECRETARY DEFENSE FOR COMMAND, CONTROL, COMMUNICATIONS, AND INTELLIGENCE. 
FORCE PROTECTION FUNDAMENTAL COMMAND RESPONSIBILITY FOR ALL COMMANDERS WHEREVER LOCATED. DOD INTELLIGENCE AND COUNTERINTELLIGENCE (INTEL/CI) COMPONENTS HAVE IMPORTANT ROLE PLAY SUPPORT THE COMMANDERS' FORCE PROTECTION MISSION. EXECUTIVE ORDER 12333 AND DOD 5240.1-R REGULATE THE CONDUCT INTEL/CI ACTIVITIES; THE ATTORNEY GENERAL HAS APPROVED THE PROCEDURES DOD 5240.1-R. THEIR PURPOSE ENABLE DOD INTEL/CI COMPONENTS CARRY OUT EFFECTIVELY THEIR AUTHORIZED FUNCTIONS WHILE ENSURING THAT THEIR ACTIVITIES THAT AFFECT UNITED STATES PERSONS ARE CARRIED OUT MANNER THAT PROTECTS THE CONSITITUTIONAL RIGHTS AND PRIVACY SUCH PERSONS. 
INTEL/CI COMPONENTS NOT HAVE LAW ENFORCEMENT MISSION. LAW ENFORCEMENT THE RESPONSIBILITY THOSE AGENCIES SPECIFICALLY CHARTERED HANDLE LAW ENFORCEMENT MATTERS, E.G., PROVOST MARSHAL;. CID; OSI; AND NCIS. (NOTE: AFOSI AND NCIS HAVE BOTH COUNTERINTELLIGENCE AND LAW ENFORCEMENT MISSIONS, WHICH ARE MANAGED SEPARATELY WITHIN THESE ORGANIZATIONS.) OFF THE INSTALLATION CONUS, LAW ENFORCEMENT THE RESPONSIBILITY LOCAL AND STATE LAW ENFORCEMENT OFFICIALS AND THE FBI THE FEDERAL LEVEL, NOT DOD INTEL/CI COMPONENTS. 
WHEN FOREIGN GROUPS PERSONS THREATEN DOD PERSONNEL, RESOURCES, ACTIVITIES -WHETHER CONUS OCONUS -DOD 

GROUPS PERSONS QUESTION MEET THE DEFINITION UNITED STATES PERSONS EXECUTIVE ORDER 12333/DOD 5240.1-R-SEE PARA 11A BELOW). BOTH CONUS AND OCONUS, INTEL/CI COMPONENTS ARE RESTRICTED WHAT AND HOW THEY CAN COLLECT, RETAIN, AND DISSEMINATE INFORMATION WITH RESPECT UNITED STATES PERSONS, EXPLAINED BELOW. 
COMMANDERS MAY NOT LEGALLY DIRECT DOD INTEL/CI COMPONENTS TARGET INTENTIONALLY COLLECT INFORMATION FOR FORCE PROTECTION PURPOSES U.S. PERSONS UNLESS SUCH PERSONS HAVE BEEN IDENTIFIED REFERENCE SUBSEQUENT VERSIONS. THE FBI PARTICIPATES THE IDENTIFICATION THESE PERSONS. 
COMMANDERS SHOULD COGNIZANT, HOWEVER, THE FACT THAT DURING THE CONDUCT ROUTINE LIAISON ACTIVITIES, DOD INTEL/CI COMPONENTS OFTEN RECEIVE INFORMATION IDENTIFYING 

U.S. PERSONS ALLEGED THREATEN DOD RESOURCES, INSTALLATIONS, MATERIEL, PERSONNEL, INFORMATION, ACTIVITIES. DOD INTEL/CI ACTIVITIES MAY ACT CONDUIT AND MUST PASS ANY THREAT INFORMATION INCIDENTALLY RECEIVED THIS MANNER THE THREATENED COMMANDER AND THE ENTITY WHICH HAS RESPONSIBILITY FOR COUNTERING THAT THREAT (E.G., MILITARY POLICY, PROVOST MARSHAL, SECURITY DIRECTOR). THIS TRANSMITTAL INFORMATION DOES NOT CONSTITUTE COLLECTION THE DOD INTEL/CI CORGANIZATION WITHIN THE MEANING DOD REGULATION 5240.1-R (REFERENCE D), AND THEREFORE PERMISSIBLE. HOWEVER, ANY FOLLOW-ON INTEL/CI INVESTIGATION, COLLECTION, TARGETING SUCH U.S. PERSONS WOULD SUBJECT EXISTING PROCEDURES SET FORTH REFERENCES 
IAW REFERENCE C., DOD LAW ENFORCEMENT AND SECURITY ORGANIZATIONS -AS OPPOSED INTEL/CI COMPONENTS -MAY LEGALLY ACCEPT AND RETAIN FOR DAYS, UNLESS LONGER RETENTION REQUIRED LAW PERMISSION SPECIFICALLY GRANTED THE SECRETARY DEFENSE HIS DESIGNEE INFORMATION PERTAINING U.S. PERSONS WHICH THREATENS DOD RESOURCES, PERSONNEL, INSTALLATIONS, MATERIEL, INFORMATION, ACTIVITIES. COMMANDERS SHOULD TAKE APPROPRIATE ADVANTAGE LAW ENFORCEMENT LIAISION ACTIVITIES MONITOR CRIMINAL ACTIVITY THE VICINITY THEIR INSTALLATIONS/ACTIVITIES (ACTS TERROR, ASSAULT, THREATS HARM, DESTRUCTION GOVERNMENT PROPERTY ARE CRIMINAL ACTS). CLARIFY THE ROLE DOD INTEL/CI ORGANIZATIONS SUPPORTING COMMANDERS' FORCE PROTECTION RESPONSIBILITIES, THE FOLLOWING GUIDANCE EFFECTIVE RECEIPT. WHEN DOD INTEL/CI ORGANIZATIONS LEARN INFORMATION PRESENTING REASONABLE BELIEF THAT U.S. PERSON OTHER THAN PERSON IDENTIFIED THE DOD DIRECTOR COUNTERINTELLIGENCE (IN REFERENCE POSES THREAT DEPARTMENTAL RESOURCES, PERSONNEL, INSTALLATIONS, MATERIEL, INFORMATION, ACTIVITIES, THE ACQUIRING UNIT SHALL IMMEDIATELY ALERT THE APPROPRIATE OFFICIAL THE THREATENED ENTITY AND PROVIDE THE INFORMATION THE APPROPRIATE LAW ENFORCEMENT AUTHORITY. FOLLOWING SUCH NOTIFICATION, THE ACQUIRING UNIT HAS REASON PERMANENTLY RETAIN THAT 

INFORMATION UNDER THE PROVISION PROCEDURE DOD REGULATION 5240.1-R, SHALL REQUEST, THE MOST EXPEDITIOUS MEANS AVAILABLE AND THROUGH ITS SERVICE INTELLIGENCE COMPONENT, THAT OASD(C31) EVALUATE THE ACQUIRED INFORMATION FOR RETENTION ("COLLECTABILITY DETERMINATION"). OASD(C31) WILL COORDINATE THE REQUEST WITH THE DOD GENERAL COUNSEL AND THE ATSD(IO) PRIOR NOTIFYING THE SERVICE INTELLIGENCE COMPONENT APPROVAL/DISAPPROVAL THE REQUEST. THE MILITARY SERVICES ARE ENJOINED PROCESS COLLECTABILITY 
DETERMINATIONS EXPEDITIOUSLY. WHILE AWAITING COLLECTABILITY/RETAINABILITY DETERMINATION, THE ACQUIRING UNIT MAY INDEX THE INFORMATION AND MAINTAIN FILE FOR DAY PERIOD. IF, DURING THAT DAY PERIOD, THE ACQUIRING UNIT LEARNS ADDITIONAL INFORMATION RELATING THE THREAT POSED THE U.S. PERSON QUESTION, THE UNIT SHALL IMMEDIATELY PASS THAT INFORMATION THE APPROPRIATE OFFICIAL LAW ENFORCEMENT AUTHORITY. (THIS INFORMATION MAY DISSEMINATED AFFECTED COMMANDERS AND SECURITY OFFICIALS, ONLY.)
