Military Commission Hearings for 9/11: Khalid Sheikh Mohammad et al.
The “9/11 Khalid Sheikh Mohammad, et al.” military commission is a joint trial of five defendants charged with conspiracy, attacking civilians, intentionally causing serious bodily injury, murder in violation of the law of war, hijacking or hazarding a vessel or aircraft, and terrorism. The U.S. government asserts that together the defendants planned, supplied, enabled and worked to carry out the hijacking of the four airplanes used in the asymmetrical attacks of 11 September 2001. This military commission remains in the pre-trial phase.

Colonel Matthew McCall, detailed 20AUG2021, is now presiding over the Military Commissions pre-trial and trial hearings for Khalid Sheikh Mohammad and the 9/11 conspirators. Judge McCall’s VOIR DIRE was taken 6-10SEPT2021. He follows Colonel Ralph Kohlmann (1MAR2007-NOV2008?), Colonel Stephen Henley (NOV2008?-17MAR2010), Colonel James Pohl (8APR2012-AUG2018), Colonel Keith Parrella (27AUG2018-JUN2019), Colonel Shane Cohen (17JUN2019-24APR2021), and interim Chief Judge of Military Commissions, Colonel Douglas K. Watkins.

Military Commission Hearings for Abd Al Rahim Hussein Muhammed Abdu Al Nashiri
The Military Commissions hearings for Nashiri are pre-trial hearings in preparation to try charges stemming from the October 2000 bombing of the USS Cole and an attempted attack in January 2000 on USS The Sullivans. Additional charges that were associated with an attempted attack in October 2002 on the M/V Limburg were dismissed in August 2014; though the government has appealed the dismissal of these charges, the appeal appears to be in limbo, and the charges have not been addressed in Nashiri’s pretrial.

Colonel Lanny J. Acosta Jr., detailed 12FEB2019, is the fourth judge to preside over the second Military Commissions proceeding for Abd Al Rahim Hussein Muhammed Abdu Al Nashiri. He follows Colonel James Pohl (detailed 28SEP2011), Colonel Vance H. Spath (detailed 10JUL2014), and Colonel Shelly W. Schools (detailed 6AUG2018). He authorized and underwent VOIR DIRE during the morning of 3DEC2019.

Military Commission Hearings for Encep Nurjaman (aka Hambali), Mohammed Nazir Bin Lep, and Mohammed Farik Bin Amin

Judge Lt. Col. Wesley Braun, USAF, was detailed to become judge of the combined case for Encep Nurjaman, Mohammed “Zubair” Farik Bin Amin, and Mohammed “Lillie” Nazir Bin Lep, but the cases were divided before he took the bench. In October 2023, he became the judge first for the combined Zubair-Lillie case, then for the Nurjaman case and underwent VOIR DIRE on October 23 and 25, 2023.

KHAN HEARING ARCHIVES

Military Commission Hearings for Majid Khan
The Military Commissions hearings for Majid Khan are pre-sentencing hearings, determining if and how it is reasonable to sentence Khan for crimes to which he has pled guilty. In 2012, Khan pled guilty to the charges brought against him and agreed to delay sentencing for four years. In 2016, Khan withdrew his plea of guilty to one of the charges that could no longer be adjudicated in military commissions (“providing material support for terrorism”) and requested a further three-year delay to his sentencing hearings. In April 2019, Khan’s defense team stated their continuing intent to pursue a mitigation case in the sentencing sessions.

Judge Col. Mark M. Milam was detailed 12 MAY 2021 to preside over the Military Commissions pertaining to Majid Khan and underwent VOIR DIRE on 27 JULY 2021. He was preceded by Chief Judge of Military Commissions, Army Col. Douglas K. Watkins.
