Judicial Watch Launches Investigation of Effort to Intimidate Conservatives

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it is launching an investigation into a nationwide effort by a liberal activist group to intimidate supporters of Republican and conservative causes. According the August 8 edition of The New York Times, Accountable America, a liberal group, plans to send a letter “to confront donors to conservative groups, hoping to create a chilling effect that will dry up contributions…The warning letter is intended as a first step, alerting donors who might be considering giving to right-wing groups to a variety of potential dangers, including legal trouble, public exposure and watchdog groups digging through their lives.

The group is also hoping to be able to respond if an outside conservative group broadcasts a television advertisement attacking Senator Barack Obama, or another Democratic candidate, by running commercials exposing the donors behind the advertisements.”

Attempts to intimidate individuals from participating in the presidential campaign can be a violation of federal law. A key federal civil rights law (42 U.S.C. § 1985(3)), popularly known as the Ku Klux Klan Act, may be applicable if “two or more persons conspire to prevent by force, intimidation, or threat, any citizen who is lawfully entitled to vote, from giving his support or advocacy in a legal manner, toward or in favor of the election of any lawfully qualified person as an elector for President or Vice President, or as a Member of Congress of the United States; or to injure any citizen in person or property on account of such support or advocacy.”

“Threats and intimidation have no place in our democratic elections and are a violation of the law. This new front group, Accountable America, seems to have crossed a legal line,” stated Judicial Watch President Tom Fitton.

Please let me know if I can volunteer to help. I am a CPA and am outraged that any group (left or right) in the political arena would have the gall to send out such a document to people participating. AA can first get rid of its "nonpartisan" mantra right now. Second, their being a (c)(4) does not give license to participate in grass roots politics and to possibly violate federal election law (your primary area of expertise). Consider me a volunteer to help you if I can be of help. THIS INTIMIDATION IS GOING TO STOP NOW!

Thank you. I talked to my wife about this on Friday, and she came to the same conclusion as I - this is an ugly escalation in an already ugly game of politics. I can see the Ku Klux Klan angle now, but my first reaction was that it felt like a protection racket, and that they were really offering a way out of trouble, if we just didn't contribute...

Which violation is easier to prove?

I agree with the CPA. The rules about being a 501(c)(4) a pretty clear. The regulations forbid:

"Direct or indirect participation or intervention in a political campaign on behalf of or in opposition to any candidate for public office"

By electing to be a (c)(4) they attempt to show they are non-partisan. However, their public words show otherwise. It may be possible to get their status reviewed fairly quickly and if nothing else force them to register as an advocacy group.

Then as an advocacy group it would be easier to look at 42 U.S.C. § 1985(3)and other laws preventing intimidation.

Just another in a long line of demonstrated left-wing hypocrisy. It conservatives made a similar threat to LSD's (Liberals/Socialists/Democrats), it would be splashed all over the media, and there would be congressional hearings held.

I hope those morons send me one of these letters. I really do.

Just because they started this campaign of intimidation I donated $ 100.00 to John McCain's Campaign.

Despicable Intimidation Tactics

I had read a story about this a few weeks back. At the time, I was positive if it was true, the effort would die out quickly. However, I also was very upset that any group, conservative or liberal, would think its proper to threaten citizens and to demand they not participate in our democratic process.
To do this, a group has to be outside the law. Demanding someone comport with specific orders of one group over another is a racket. Organized crime tried to do this and eventually they were exposed and prosecuted for their actions. However, in the meantime, they adversely affected the outcome of who knows how many elections?! In today's world, the time available to wait for such groups to be prosecuted is very little. Time is the critical element in such affairs today.
These folks should be prosecuted under "RICO Act" guidelines, plus they should face federal election law violations prosecutions. In addition to this, if these group actually carry out their threats, investigators should look at who all is behind such an organization. Because those pushing this group into action should also face prosecution. The uber wealthy have lately used their wealth to force actions by politicians and government officials, that is either not in the public interests or provides them with a specific result that is in their special interests. Either is a crime against the American public.
We have people involved in our political processes today who should not be involved. We have international financial types, international diplomatic types, foreign governments types, and others who are not citizens, actively acting to affect our national political system. These actions must be curtailed immediately. There is no justification of a foreign entity acting to affect our political processes. And, the wealthy do not participate in these activities w/o expecting substantial returns for their investments. George Soros is a citizen as far as I know. However, why would a billionaire invest the "HUNDREDS OF MILLIONS of dollars he has, unless he expected to be able to demand a return for his favors? He cannot become president, but he can pull the strings of the presidency if a president owes him favors for the money's he has contributed. No one invests these kinds of money's unless they expect or have been promised specific favors in return. If no favors are expected or promised, then why would one of these very wealthy people invest so much money?
Judicial Watch does American citizens great justice when they watch over these activities and those involved, and when their investigations uncover and allow legal proceedings to be conducted to prosecute those who violate our laws, because they used their influences to force results that otherwise in a fair accounting would never have happened!

SUBJECT: Solicitation to Violate Indiana Elections Code 3-8-3-11, Delegates to national convention; support of candidate on first ballot

Dear Attorney General Carter:

Here in Indiana, obeying the above-cited law means that pledged delegates selected as the result of votes cast for Senator Clinton in the Presidential primary election must vote for her during first-round balloting at the nominating convention of the Democratic Party. But in what can at best be interpreted as an overzealous advocacy on behalf of Senator Obama, in states throughout the country, including Indiana, proponents for his nomination have bombarded Senator Clinton’s delegates with subtle and not-so-subtle pressures to commit to switching support to him, before the convention. Or, failing that, they replace the Clinton-pledged delegate with one loyal to Obama. (See examples below. Note that while the first link shows the copy of a letter Senator Obama’s campaign sent to pledged delegates in Georgia, they distributed this same letter to delegates in all states. And Georgia, like Indiana, mandates pledged delegates to follow their candidates into the convention.)

Therefore, in Indiana (and Michigan, and Texas, and California, and numerous other states), encouraging delegates entrusted with representing the political preference of Clinton voters to pledge their support before the convention to Obama solicits these delegates to break the law. As a concerned citizen of Indiana, I am bringing this matter to your immediate attention, anticipating you will take appropriate action to ensure from now on, any campaigning in this state related to the upcoming Democratic National Convention is consistent with Indiana laws.

The law makes it illegal to intimidate, a "before the fact" action. Once an individual has made a contribution or supports an advertisement then he or she becomes fair game. There is nothing illegal about exposing the people behind an ad AFTER the fact. What's illegal is trying to get them not to participate in the electoral process. AA were fools to announce their intentions and leave themselves open to prosecution.
