Judicial Watch Statement on the Retirement of Justice Souter

Judicial Watch President Tom Fitton issued the following statement today in response to reports of the impending retirement of Justice David Souter:

President Obama will have a fight on his hands if he nominates a judicial activist to replace Justice Souter. President Obama said during his campaign that he would appoint judges who have the "empathy to understand what it's like to be poor, or African-American, or gay, or disabled, or old." Americans want the Supreme Court to make decisions based on the Constitution and not on some lawless standard that puts identity politics before the law. If Obama nominates someone in line with his campaign promises, Senators who want to protect the Constitution will have no choice but to oppose his nominee.
