I am so angry about this. If you have ever had or known anyone who's SSN was used by someone else, even in another state, you know what a mess this can make of your sanity and financial security. Just because someone does not know the person to whom the SSN belongs to, still knows it doesn't belong to them. I wonder, since I'm an American citizen, if I was to use a SSN of a person I don't know, if I would not be charged with identity theft! I seriously doubt it. I would be prosecuted to hell and back!
In my opinion it is identity theft. If it is not their own legitimate identity then they are stealing an identity, whether or not a person is using it at the time. Can this decision be appealed?

With Obama and the "progressives" doing their best to give away our country, this decision by the Supreme court doesn't surprise me.
All this means is we are going to have to fight even harder to stop them! It's time we become very high profile! We need to been seen in the streets! Mass street marches, public meetings, and showing up to protest ALL pro-illegal immigration meetings and marches!
Obviously, illegal aliens are being supplied with fake identities either through their employer, relatives, or friends in the U.S. Perhaps the illegal alien didn't realize they were stealing someone else's identity, however, they did know that they entered the U.S. illegally and the documents they paid for weren't obtained from the INS in accordance with U.S. immigration laws. That person knew that their documentation was fake and lied on their job application and W-9. The illegal alien should turn in those persons that provided the fake ID because they should be prosecuted for identity theft and possibly RICO violation (it's organized crime). The illegal alien requires deportation for breaking our immigration laws and buying fake documentation.
This is an outrage of our liberal justice system and would they do the same for an American Citizen. The supereme court should be ashamed of itself to allow such rediculous rulings. GOD help America the corrupt.

After looking at the ruling the problem is that the law reads "knowingly transfers, possesses, or uses, without lawful authority, a means of identification of another person.” 18 U. S. C. §1028A(a)(1) (emphasis added).
The court said that you had to prove that the person knowingly used an SSN that belonged to another person and not just a fake set of numbers such as a fake ID.
When he stared work in 2000 the documents presented where fake and the numbers did not belong to another person, in 2006 he changed the documents to indicate his real name and the numbers used this time belonged to a real person.
Since the government could not prove he knew that the new information belonged to a real person he did not violate the law.
Congress need to change the wording of the law to remove "of another person" and close this loophole for the illegals.Not likely with the current criminals in Congress.

Obama has his relatives in US illegally and using public housing so why would he prevent things like this. Great job liberals ! now you have elected this guy he will make sure if he cannot rob us with new taxes illegals will steal our identities.

Yet I absolutely think the Supremes did their job in this case: they applied the law. Our criminal legal system requires that the prosecutor prove that a criminal statute, as written, was violated. In this case the Supreme Court found that the plain grammatical meaning of the statute required the prosecutor to prove that the defendant knew the social security number was a real one belonging to another person as opposed to a fake, invalid number belonging to no one (e.g. 222-33-4444). The correct remedy here is to change the law so this situation does not happen again. The Supremes did what we conservatives want them to do: they refrained from being activist judges who make up or twist whatever law they want to. -- Mrs. Gumbo
