His immigration status is completely relevant, because he was not a citizen, he did not have a license to drive in Texas. Seems relevant in a traffic case.

I disagree with the judges. this is like saying we can't reveal he's a 16 year old and about his alcohol use because of his age, if he killed a family and he was legally here, they would definetly reveal his age and his acohol use. Illegal immigrants will eventually bankrupht every state.

play with words while these illegal aliens have 3, 4, 5 or more children supported by our OWN tax money instead of supporting us and our children.

"[R]acial prejudice" ? He might be a Mexican or whatever race and ethnicity, the FACT is that if he was an illegal alien he shouldn't have been given that job to drive a truck. Freakin' companies hire cheap labor.

I'm so sick and tired of the people who say that these illegals do the jobs most Americans won't do. WTF for 5, 6, $7 /hour ? What decent person and family can survive on that?

Increase the minimum payment to a decent level (like our dear elected officials do with their OWN compensation) and MANY Americans WILL get those jobs, more now with all this crappy economy, but we would have taken them even before the financial and housing bubble went to hell.

In NYC if the police stops a middle east man for questioning they are racially prejudiced. How come?
Because we DO KNOW that middle east men between 16 and 55 are more likely to commit acts of terrorism ?

We have the information and know how to act on it, but for the sake of being politically correct we are going to lose in the end with all the aces in our hands.

Deport the illegals and be done with them and build a DAMN AMERICAN WALL bigger than the Chinese wall because we can. What we lack is the simple WILLINGNESS to do it.

The illegal status of the driver is relevant to finding the trucking company at fault and liable for the damages awarded. They are criminally negligent because they broke the law in hiring an illegal alien, who was also unqualified to drive their truck. They are liable for the deaths caused by their employment of the unlicensed driver, and allowing him to operate one of their trucks to fulfill one of their contracts. It is no different then a hospital allowing a doctor to operate on a patient that dies on the table, only to find that the man operating on the patient was not a doctor at all, but used fake credentials that the hospital failed in it's due diligence to check and confirm.

The suit is against the trucking company, not the driver. If the case were overturned by a lower court, it would easily be appealed to the Supreme Court. Any company with the responsibility to ensure it's employees are qualified and trained to operate their equipment or facilities, are liable for damages caused by their specific failure to ensure their employees are qualified, regardless of the employees status.

I have a feeling that the case would be settled out of court, as a retrial or escalation to the Supreme Court would be too costly for either party.
