According to the FOIA Guide published by the Dept. of Justice (March 2007 edition - I believe there's a new one but I don't have it yet), FOIA does NOT apply to a presidential transition team. (See page 50 of the guide. Cited are Ill. Inst. for Continuing Legal Educ. v. U.S. Dept. of Labor; Wolfe v. HHS.) This was decided long before President Obama.
