Gregory held up an illegal high-capacity magazine on Meet the Press during an interview with NRA’s Wayne LaPierre in December 2012, which focused on the Newtown shooting. DC attorney general Irvin Nathan decided not to prosecute Gregory, which is why Judicial Watch, representing Legal Insurrection, filed a FOIA lawsuit against DC’s government to obtain documents regarding Gregory’s non-prosecution.
