Judicial Watch Statement on Declarations by IRS Officials in the IRS Missing Emails Case

AUGUST 11, 2014

(Washington, DC)Judicial Watch President Tom Fitton made the following statement in response to today’s sworn declarations from IRS officials Aaron G. Signor, John H. Minsek, Stephen L. Manning, Timothy P. Camus, and Thomas J. Kane, which were provided to the federal district court on order from Judge Emmet G. Sullivan regarding the “lost” emails of Lois Lerner and other IRS officials.  The conveniently missing emails have been the subject of longstanding Judicial Watch Freedom of Information Act (FOIA) requests and lawsuit (Judicial Watch v. IRS (No. 1:13-cv-01559)):

These sworn declarations delivered to the court today were to discuss what happened to Lois Lerner’s “lost” emails and any other computer records reportedly lost by the IRS.  This latest IRS filing seems to treat as a joke Judge Sullivan’s order requiring the IRS to produce details about Lois Lerner’s “lost” emails and any efforts to retrieve and produce them to Judicial Watch as required under law. Frankly, it seems the cover-up continues.

Judge Sullivan authorized Judicial Watch to submit a request for limited discovery into the missing IRS records after September 10.

Magistrate Judge John M. Facciola was appointed by Judge Sullivan to manage and assist in discussions between Judicial Watch and the IRS about how to obtain any missing records from sources. Magistrate Facciola is an expert in e-discovery.

Did they also tesify about the 20 other computers that crashed? It would also seem important to find out how
the department is handling tax exempt applications now. The saying that justice delayed is justice denied
    comes to mind.

I absolutely believe that Lois Lerner was employed by the I.R.S. but was really working for the Democratic Party.

Why isn’t Lerner being called to testify and let her tell a Federal Judge why she is innocent and then launch into her , I plead the 5th. act ?

Water Boarding sounds about right. I suspect you would have some answers in a nano second.

Just a choice, the e-mails or your pension.

This has all taken WAAAAY TOOOO long to produce almost nothing! The IRS was doing this as early as 2010–it’s now 2014–that’s 4 years even with the new Common Core math! Time and time again documents have been requested and the documents failed to be produced–so they again asked for them–again no show–and again and again–then 3 years in they FINALLY get subpoenas and they are ignored–L. Lerner took the 5th–then ALL OF THOSE EMAIL OF LERNER’S AND SEVERAL OTHER MAGICALLY DISAPPEAR BUT FOR ONLY THE EXACT TIME THAT THEY WERE BEING INVESTIGATED FOR!!! LET’S DEMAND THAT ALL OF THE PEOPLE INVOLVED EITHER RELEASE THE DOCUMENTS OR **SIT IN JAIL** UNTIL THEY DO!!!
Now that the lost email story worked so well now every agency that is being looked at have lost their emails too!
IN NOV. 2014 LETS CLEAN HOUSE–THEN AGAIN IN NOV. OF 2016!!! ENOUGH IS ENOUGH!

Oops! my hard drive just crashed. May I use your laptop? I need to check my e-mail. Oh, never mind, I’ll just use my cell phone.
That, my friends is the simple answer to missing e-mails.

We do not have the luxury of ignoring the Court system. We would wind up in jail.
This conduct is bad for the entire country. We can clearly see that Justice is not blind.

    Waterboarding would be better..carry on…

We tried our best to recover the emails. Trust us. Take our word that we tried our best. Why would we lie to you? We wouldn’t even smidgeon lie to you…

This is just another snub at the justice system. The Obama administration thinks (knows) it can get away with anything they want and Holder will sweep this under the carpet. Like Harry Reid said, this country is run by laws and regulations, but democrats are immune to the same. The presidency is absolutely out of control and I can’t understand why they are getting away with such evil.

Introduce them to prison, a moderately long term that should give them the opportunity to consider how they could be either so obstinate towards the courts & the law, or so negligent in their duties which ever is appropriate.
