JW Obtains IRS Documents Showing Lerner in Contact With DOJ about Potential Prosecution of Tax-Exempt Groups

APRIL 16, 2014

May 9, 2013, email reveals IRS plans to meet with Department of Justice over whether to prosecute groups that “lied” about plans for political activity

(Washington, DC) – Judicial Watch today released a new batch of internal IRS documents revealing that former IRS official Lois Lerner communicated with the Department of Justice (DOJ) about whether it was possible to criminally prosecute certain tax-exempt entities. The documents were obtained as a result of an October 2013 Judicial Watch Freedom of Information Act (FOIA) lawsuit filed against the Internal Revenue Service (IRS) after the agency refused to respond to four FOIA requests dating back to May 2013.

The newly released IRS documents contain an email exchange between Lerner and Nikole C. Flax, then-Chief of Staff to then-Acting IRS Commissioner Steven T. Miller discussing plans to work with the DOJ  to prosecute nonprofit groups that “lied” (Lerner’s quotation marks) about political activities. The exchange includes the following:

I got a call today from Richard Pilger Director Elections Crimes Branch at DOJ … He wanted to know who at IRS the DOJ folk s [sic] could talk to about Sen. Whitehouse idea at the hearing that DOJ could piece together false statement cases about applicants who “lied” on their 1024s –saying they weren’t planning on doing political activity, and then turning around and making large visible political expenditures. DOJ is feeling like it needs to respond, but want to talk to the right folks at IRS to see whether there are impediments from our side and what, if any damage this might do to IRS programs.

I told him that sounded like we might need several folks from IRS…

I think we should do it – also need to include CI [Criminal Investigation Division], which we can help coordinate. Also, we need to reach out to FEC. Does it make sense to consider including them in this or keep it separate?

Lerner then “handed off” scheduling the issue to Senior Technical Adviser, Attorney Nancy Marks, who was then supposed to set up the meeting with the DOJ.  Lerner also decided that it would be DOJ’s decision as to whether representatives from the Federal Election Commission would attend.

Democratic Rhode Island Senator Sheldon Whitehouse had held a hearing on April 9during which, “in questioning the witnesses from DOJ and IRS, Whitehouse asked why they have not prosecuted 501(c)(4) groups that have seemingly made false statements about their political activities.”  Lerner described the impetus for this hearing in a March 27, 2013, email to top IRS staff:

As I mentioned yesterday — there are several groups of folks from the FEC world that are pushing tax fraud prosecution for c4s who report they are not conducting political activity when they are (or these folks think they are). One is my ex-boss Larry Noble (former General Counsel at the FEC), who is now president of Americans for Campaign Reform. This is their latest push to shut these down. One IRS prosecution would make an impact and they wouldn’t feel so comfortable doing the stuff.

So, don’t be fooled about how this is being articulated – it is ALL about 501(c)(4) orgs and political activity

But in an email sent a few minutes earlier, Lerner acknowledged prosecutions would evidently be at odds with the law:

Whether there was a false statement or fraud regarding an [sic] description of an alleged political expenditure that doesn’t say vote for or vote against is not realistic under current law. Everyone is looking for a magic bullet or scapegoat — there isn’t one. The law in this area is just hard.

The documents also include email exchanges showing that before Lerner’s May 10, 2013, speech to the American Bar Association blaming “low-level” employees in Cincinnati for targeting tax-exempt organizations, the IRS Exempt Organizations division was scrambling to defuse the emerging targeting scandal:

  • May 1, 2013: After receiving an email from an assistant showing that 501(c)(4) applications had increased from 1591 in 2010 to 3398 in 2012 , Lerner wrote back, “Looks to me like 2010-2012 doubled too. Oh well – thanks.”
  • May 2, 2013: Discussing an upcoming conference call with approximately 100 congressional staffers on May 22, Lerner cautions aides, “Need to be careful not to mention sequester/furlough unless asked although can allude to budget and resources restraints.”
  • May 2, 2013: In response to an email reminding her about the upcoming conference call with congressional staffers, Lerner responded, “Arrgh – I just saw it. Sharon [White] could skate, but Cindy [Thomas] is the person who could answer that stuff. We need to give them some type of language in the event that type of question comes up” [apparently in reference to earlier email referencing “sensitive issues”].

The new documents obtained by Judicial Watch also include emails exchanged after Lerner’s May 10 ABA speech:

  • May 10, 2013: In an email to an aide responding to a request for information from a Washington Post reporter, Lerner admits that she “can’t confirm that there was anyone on the other side of the political spectrum” who had been targeted by the IRS. She then adds that “The one with the names used were only know [sic] because they have been very loud in the press.”
  • May 15, 2013: In an email from an aide to Lerner, the aide specifically mentions “Tea Party Organizations, the “Tea Party movement,” and “Tea Party Patriots” as organizations targeted by the IRS.

The Judicial Watch FOIA requests came on the heels of an explosive May 14, 2013, Treasury Inspector General report revealing that the IRS had singled out groups with conservative-sounding terms such as “patriot” and “Tea Party” in their titles when applying for tax-exempt status. The IG probe determined that “Early in Calendar Year 2010, the IRS began using inappropriate criteria to identify organizations applying for tax-exempt status to (e.g., lists of past and future donors).” According to the report, the illegal IRS reviews continued for more than 18 months and “delayed processing of targeted groups’ applications” preparing for the 2012 presidential election.

Lerner, who headed the IRS division that handles applications for tax-exempt status, refused to testify at a May 2013 hearing before Rep. Darrell Issa’s (R-CA) House Oversight Committee, demanding immunity concerning her role in the targeting scandal. Lerner retired from the IRS with full benefits on September 23 after an internal investigation found she was guilty of “neglect of duties” and was going to call for her ouster, according to news reports. On April 9, 2014, the Ways and Means Committee referred Lois Lerner to the DOJ for criminal prosecution. On April 10, 2014, the House Oversight Committee voted to hold Lerner in contempt of Congress.

“These new emails show that the day before she broke the news of the IRS scandal, Lois Lerner was talking to a top Obama Justice Department official about whether the DOJ could prosecute the very same organizations that the IRS had already improperly targeted,” said Judicial Watch President Tom Fitton. “The IRS emails show Eric Holder’s Department of Justice is now implicated and conflicted in the IRS scandal.  No wonder we had to sue in federal court to get these documents.”

That is nothing new. All my life I’ve gotten insurance through my employer. With the advent of HMO’s, PPO’s etc, each enrollment period I had to ensure that my doctor was included in the group that accepted my insurance. There have been times I’ve had to change my plan because for some reason or another my doctor was no longer participating in my former plan.

  • joeblow1984

You mean as if you like your doctor you can keep your doctor, period.
If you like your healthcare plan you can keep your health care plan, period.
If you own a business, you didn’t build that.
If congress won’t act, I have a pen, and a phone.
The constitution is an old and outdated piece of paper.
Yeah real smart those typical dems.

  • joeblow1984

And direct them to a youtube video that started it all.

  • joeblow1984

The IRS needs to be abolished, and replaced with a flat tax, with massive cuts to entitlements and spending. We lived without the IRS at one time, and we can do so again. But RINOS, and Democrats are always getting in the way of true and meaningful reforms. Using your logic, it is only fair that the head of the AFL-CIO, Teamsters, and SEIU should go to jail too.

  • joeblow1984

Perjury, obstruction of justice, interference with an ongoing investigation, spoliation of evidence for starters.

  • dale ruff

Tea Party groups are not exclusively social welfare agencies, as the Congressional law mandates to qualify for tax exemption. None of them, nor those on the left, qualify. The IRS has perverted the law for 55 years. Karl Rove is hardly exclusively involved in social welfare work. No one believes this…he should go to jail for lying to the IRS, as should all those who have claimed to be doing social welfare work but actually are oganized for partisan purposes.

The real scandal is 55 years of ripping off the public.

  • Howie_Roark

Depends on perspective – they may not be able to claim majority support, but as of the end of last year, more people claimed to identify with the values of the Tea Party than any other political group or entity in America – more than the Democratic Party, more than the Republican Party, and more than the President…and I would wager that this sentiment has only grown since then.

  • Howie_Roark

Obama could tear puppies in half, and stomp in babies’ heads on live TV, and the Left would cheer him on, then pretend it never happened.

  • I hate liberals

Cummings, Lerner, Holder, Could this go up to Obama ? Bet you since these hard drives are destroyed it does!

  • joeblow1984

Lerner should be imprisoned immediately! So should Elijah Cummings.

  • http://thegreatiamtheoriginallight.blogspot.com/ TheOriginalLight

We already know the answer. To be a liberal is to be a hypocrite. They couldn’t care less about their consistent targeting of conservatives when it comes to partisanship. There was never a chance in the world that they would go after the holy grail of liberalism and target Planned Parenthood.

  • Steven Michaels

Just thinking out loud about IRS. I didn’t notify the IRS that they owed me funds for a few years ( didn’t file ) But I did withhold a great deal more than I owed. So I should have received a minor fine for not telling them they owed me money but instead they tried to pump up fines on money they thought I owed but didn’t pay ! When I told them they couldn’t fine me for money they already had they tried to tell me they could because they didn’t know i had paid the money because i didn’t tell them i had !!! Of course after talking with a supervisor it got straightened out but It just seems to point out that the IRS isn’t exactly the smoothest operation we have in the USA. Most of those targeted were guilty of lying on their forms and were not eligible for tax exemptions . Was it handled wrong ? yes … but were the people targeted innocent? for the most part no . As far as Issa goes … he has wasted a lot of money going from one investigation to another with nothing to show us for his efforts but costing us millions for his witch hunts… Let’s get the IRS straightened out … get it properly funded and staffed so that it has no more excuses to operate properly .

Everything that Obama’s administration has done is worst than Watergate, but the mainstream media – and many citizens – no longer care about integrity.

  • beowolfe

I still can’t make out what your avatar is. But it’s interesting.

  • beowolfe

You would think that. But ‘giving’ and ‘not being able to prevent’ are two very different things. But I wouldn’t expect people on the right to get that. Obama wasn’t POTUS when the economy tanked; Bush was. So, if you’re going to blame Obama for anything vis-a-vis the unemployment rate, blame him for not being able to stop it from tanking.

  • delahaya

I don’t know. To me dumb would be supporting the president (Obama) who gave us record high sustained unemployment rates, a tripling of the long-term unemployed, record high homelessness, record high food stamp dependency, record high deficits and debt growth, record destruction of middle class wealth, record increase in health insurance costs, and the country’s first-ever credit downgrade. Maybe dumb is not the right word, maybe “hates his own country” is the right word. After all, if an enemy had done to our country what our own President, Obama, has done we’d consider it an act of war. You can make all the snarky replies you want, but my post involved statistics that can be researched. Look them up.

  • delahaya

That’s the problem with today’s liberals, they are all juvenile smartasses like you. You know exactly what he means but are just being difficult because that’s what you do – or either you’re just not very smart. Maybe both?

  • delahaya

It did, but nothing will happen. The Democrats, and their supporters, are corrupt, and too many of the GOP are spineless.

  • Richard Doumani

This should be enough to slaughter, butcher ,and Dan Ratherise all of the Left Wing Supportive media.
Take Chris thrill up his leg Mathews . He criticized the so called crazies like Daryl Issa, and Louis Gomer for denying Lois Lerner her constitutional right by pleading the fifth.
Should we halt all criminal probes and investigation as soon as a citizen invokes their constitutional rights to the fifth.
Such fights for Freedom by Judicial Watch should hammer heavily about the subversive media support for all the scandals of this administration. Bob Schieffer is no longer competent to conduct an objective interview as displayed when he interviewed Elijiah Cummings.
Maybe some criminal probes will turn out from media lies and cover ups which do not protect them under the constitution.

  • GailfromPA

Awesome comment TheFallofAmerica! The Obama list could be so much longer, but you’d probably give yourself carpel tunnel syndrome from too much typing.

  • twinstick1

No worries. With this bunch in Office now, anything is possible…

  • Angie Nathan

No that is not my definition of freedom, however individual liberty could be used as a barometer so to speak in determining how free a society is. Although there are other aspects to “freedom” in a society, I do not feel that there is true freedom without the highest protections being afforded to liberty of the individual. Can you have life and liberty without allowing the pursuit of happiness?

  • silence_dogoode

Agreed, not as long as this administration and the 5th Columnist in the mainstream media continue to demonize the Tea Party and mis-inform the general public about the Tea Party in their collaborative campaign against them. This story should be head-lining and splashed all over the news, and would be if this were a republican administration and left wing organizations were the targets. But with the exception of a couple of shows on FOX news all we get are crickets.

BTW. Not all these groups were Tea Party. One group Elijah Cummings, ( the minority chair of the Oversight committee, the committee investigating this scandal! ), went after is True The Vote and they aren’t Tea Party.

This kind of deliberate ‘chilling’ of citizens’ 1st Amendment rights by a presidents administration and his political party is unprecedented in our country, yet the silence is deafening.

And of course we can expect absolutely nothing from the republican leadership. Boehner and his cronies in D.C. are too busy attending D.C. cocktail parties with the elite and colluding on how to legalize the millions of illegal aliens from Mexico in hopes of picking up a vote or two for the R’s to be bothered with going after this administration.

As with all the other blatant corruptions that we know of being perpetrated by this lawless administration, this too will be swept under the rug by the press, ignored by most republicans, and ALL the democrats, and no one but the American people will be made to “pay the price” because so many of them have bought into all the vitriol being spewed about the Tea Party and so excuse the behavior or don’t care enough to do anything about it.

Today, conservative organizations and the Tea Party are being targeted, tomorrow, whoever they damn well please to target because the precedent will have been set without the majority of the good, complaisant people of this country raising a finger to stop it.

  • James Edward

Is that how you define freedom?

  • cmdprompt

It will do no good, but I’ll address your disinformation. They admitted it. SHE admitted it, before pleading the fifth for fear of self-incrimination. Heck, the president as much as admitted it before he backtracked. This was just prior to the IG releasing the report on their investigation that this HAD INDEED been going on. The IG isn’t a partisan role. They are independent. Throw on top of that the emails in this article, you would have to be a brain dead moron (or a paid shill propagandist) to believe nothing was going on.

I’m not a tea-party anything. I am however an American and seeing this level of abuse and corruption is chilling. Eventually, the shoe will be on the other foot Egan Foote (pun fully intended) and your “side” such as there are sides, will not be in power, but will be on the pointy end of this type of abuse. That alone should chill your soul; but it doesn’t. You foolishly think you will be immune from persecution. That isn’t the way political corruption works.

  • beowolfe

Yes, I saw them. And neither one of them changes the meaning of what was said, unlike the poster I was responding to. You are a typical republican, dumb, but swears he’s/she’s smart.

Watergate happened on January 1972 and the Scandal blew up on March 23, 1973. The Senate began investigating on February 7, 1973 and the House passed House Res. 803 authorizing Impeachment. Nixon resigned on 8 August 1974.

The News was fully cooperative and were the fully investigated the
initial break-in — without Reporters, Watergate would have been
dismissed, and indeed was for over a year. Nixon tried stonewalling, but with both the House & Senate under Democratic control (One Party control) he couldn’t. Ultimately, his High Crimes brought him Very Low (Watergate, using the IRS to target political “enemies”, wiretapping, etc).

The point of this is, investigations take time even under the best of conditions. I was a Police Officer for 25-years, and with the most complicated investigations they can take a very long time. This is one investigation that needs to be looked into with “Clear Eyes” & away from “Political Influence” — a Special Prosecutor needs to be appointed to look into matters…however, I do not think that will happen.

Why hasn’t lying criminal Lois Lerner been put in prison by the House of Representatives? Under the Constitution, the House makes its own rules and establishes its own officers. Why hasn’t the House, established a rule specifically for Lois Lerner, to place her under the arrest by the House, and imprisoned her in the House jail (they do have a jail) until the House decides who their jury will be and try her for contempt of the House of Representatives. Is it because Boehner is a coward and/or Barack Hussein Obama is blackmailing him? Loir Lerner should be in prison along with Eric Holder.

These people are professionals and lawyers. They know what can create issues for them. The bottom line (regardless of documented evidence) is that there was a coordinated effort to hassle and diminish the impact of Republican advocates – teaparty and all.
For the MSM, this is not voter fraud or disenfranchisement. But asking for Voter ID to reduce voter fraud is, because Democrats are the ones that have dead people voting, ballot-box stuffing, more voters than residents or registered voters etc.. Our society is made up of too many people who know very little (about political issues) and we have a MSM that muddles everything for them. The MSM is also biased in a way that they are deceitful. They are also advocates for the left. e.g. when Obama says he was against gay marriage, they all went along. when Obama says he is for gay marriage, the MSM make it such that if your head did not spin around like Obama, then you are a bigot. thus we have Bendan eich.

He spoke of Al Qaeda. So here’s something to think about. He said:

“If an American joins AQ, and begins making threats against the US or assisting non-American AQ members in planning or carrying out actions against US citizens, then yes, they are fair game.”

You mean like when President Obama does it, by giving aid and comfort to US enemies by sending weapons to Al Qaeda through Libya through Ambassador Stevens and the ambassador is killed right before the election? Or when Obama refuses to negotiate with fellow Americans across the aisle so he can jump onboard Air Force One to go sit down to negotiate with America’s sworn enemies in Iran and give them access to money they will use to expand their nuclear weapons program which they fully intend to use against the US?

Is that your definition of “fair game” . . . ?

Nixon was a boy scout, I am still not sure even to this day what he did that was illegal, that the Democrats were not already guilty of a 100 times over. For crying out loud Democats ignore that LBJ, and Kennedy voted against civil rights twice, and refused to dismantle the KKK, that was done with GOP suuport. Also Kennedy used the IRS to audit Nixon’s mother, and brohter, and Nixon himself in the election where Nixon campaigned against Kennedy. People really need to go back and read the private diary of Nixon, this sheds extensive light on the fact that Nixon was the real deal a politician who truly wanted to help America,. and America sh** all over him for ending Vietnam, fighting for civil rights, and other things.

She then adds that “The one with the names used were only know [sic]
because they have been very loud in the press.”

    May 15, 2013:
In an email from an aide to Lerner, the aide specifically mentions “Tea

Patriots” as organizations targeted by the IRS.

Said by the so-called progressive who is above desperately trying to justify why the left is silent about Obama’s drone strikes. Wow. Your rationalization is amazing. So that makes it OK? I thought Obama was supposed to be different? Why was he given the Nobel peace prize then? The bottom line is – the left is full of hypocrites. I remember the anti-war marches under Bush. People were sooo upset that we were at war in Iraq and supposedly marching for peace. Obama gets into office, and puts a ton more troops into Afghanistan, and immediately the left backs him up because, well, he did this in a “reasoned” manner. Then Obama tries to get us into a war in Syria based on a lie, and the left is silent. The ACLU is desperately trying to get justice for the victims of drone strikes, but other than them, the left is silent. Truly showing your true colors – hypocrites, who don’t actually give a damn about peace.

“You don’t seen anyone on the left cheering for drone strikes.” Actually, go read comments on Kos written last week about the situation in Nevada with Cliven Bundy. Numerous commenters there actually said they’d like a drone strike to kill Bundy. The left is totally OK with war and drone strikes as long as it is agains their “enemies,” which right now are the Tea Party and anyone who won’t go along with their progressive vision in America. So it’s not just that the left is quiet about drone strikes – which is enough hypocrisy – but when push comes to shove they are totally OK with violence being used against Tea Party people. Which is why they (and you) are perfectly OK with Lois Lerner going after so-called “wingnuts” because you have NO RESPECT for anyone in America who does not think like you do.

100% agree – but the reason why the left is OK with this total abuse of power is that they are delusional – they honestly believe that they have won the country and they will be in power forever more. Notice how often they’ll say things in the comments that so-called “white conservatives” are dying out? It’s not about “white male conservatives” – I am a female and former Democrat who woke up and became libertarian. The Mexican immigrants they are so desperate to bring into the country as a supposed sure voting bloc are extremely conservative socially and could end up turning their vote conservative if the Democrats keep going further left socially. So they don’t realize that they could lose big time and then we could have another Bush in the White House.

The corrupt and cynical press will continue to provide cover for the Obama administration’s many lies, broken promises, abuse of power, flaunting of the Constitution and laws, crony capitalism, failures, etc. They ignore the awful reality.

By the way, my friends on the left, this does not bode well for you are any of us when the power changes hands. You keep repeating one big stupid lie – that there is no evidence when it’s right in front of you. Classic propaganda technique – repeat one big lie.

  • Egan Foote

They weren’t scrutinized because of political affiliation; they were scrutinized because of engaging in political activity while claiming to be a social welfare group. And by “they” I mean both conservative and liberal groups attempting to subvert the law and who should (and were) subjected to scrutiny).

  • beyond partisan

Clearly you do or read their off-shoots like Kos. You are a brainwashed fool if I ever saw one.

  • beyond partisan

So please tell me…why are you so foolish to honestly believe that Obama is “for the people” when he was put into power with big Wall Street money, helped Wall Street cronies when in office, and uses drone strikes to kill people without trial?

  • James Wordsmith

These investigations into this IRS abuse of power, need to be stepped up in priority and publicity.
Otherwise this abuse of power will continue with impunity and brazen confidence, and just become a footnote in history.

  • vassago1

Don’t deflect, no one likes a communist, well other than the people at your dinner parties.

I’m not here to do your READING and RESEARCH for you. You have the article in front of you and yet deny what it is in it. So let me ask you – do you feel good about empowering the Obama administration, which was put into place by big money interests (research his Wall Street donations), and is in fact just as if not more warmongering and NeoCon than Bush ever was (research his drone attacks). You are a total fool if you honestly think that the Democrats are truly “progressive” besides a few social issues they push as hot buttons. Meanwhile, they are hungry for power and looting the treasure for their own cronyism and corporate socialism. What a total, utter FOOL you are for believing them.

They have no evidence so they can’t answer your question.

  • indythinker99

You are in deep denial, my friend.
The “proof” is the lengths the IRS went to delay and keep Tea Party groups from obtaining 501(c)(4) status, while letting left-wing liberal groups fly through the process with no problem.
It can’t any more clear it was politically motivated.

  • Egan Foote

Also, contempt charges must carry some time at the gray bar motel, Kind of like what has happened in the past since Nixon.

  • beyond partisan

IT IS IN THE ARTICLE ABOVE!!! Are you a dimwit or purposefully being dense? By the way, do you like to cite “Media Matters” as being the truth? Are you OK with the reports that when a writer tries to be critical of Obama on Media Matters, for example, on his policy of drone striking innocent civilians, Media Matters censors and fires that writer?

  • wkherbert

I get the feeling trying to reason with you is akin to beating one’s head against the wall.

The reason we know of the IRS abuse is due to Lerner’s confession that the IRS had targeted conservative groups. That is a piece of evidence. Eliana Johnson and Bradley Smith have provided extensive investigation and reporting and supplied other strands of evidence. The Washington times and Wall Street Journal have provided additional evidence and timelines. Issa and the committee uncovered additional evidence. The testimonies of those targeted is further evidence: perhaps listen to Catherine Englehect’s telling of 17 visits from federal agencies and one from Cummings who lied about his own involvement.

I don’t know what evidence means to you but to most people the evidence is overwhelming that the IRS target conservative groups and continues to do so.

  • Egan Foote

So, long story short, no evidence?

  • vassago1

Even more hilarious you did not disagree with me calling him your master. Now what was that about hammers and sickles.

  • vassago1

So if we twist the words and say that being scrutinized because of your political affiliation is ok, but being targeted is wrong, does that make you feel better about it.

  • JallopyMacfurry

There was far, far, far, far less evidence against Nixon. He simply said on tape he wished he * ould* use the IRS, for what Obama has already clearly done. The evidence you’re asking for is why they take the 5th, and refuse to give requested documents. The evidence you’re looking for is around why tthe head of the IRS visited the White House more times after the 2010 election and before the 2012 election, than all IRS heads have visited the White House in US history. So you’re either a fool, or a lying leftist. (or both ;)

denying real numbers isn’t either. I know math is hard and so is reading comprehension, especially when you were raised and educated in Detroit.

  • Egan Foote

Seriously? That is all you got? By that logic, partisan hack Darell Issa could convene a hearing claiming that President Obama is from Mars and you would believe it because “why the congressional hearing about it.” Again, you have not provided any evidence. That is all I am asking for: one shred of evidence.

  • beyond partisan

I already told you below that this site has it all very well documented. You are here as a propagandist to DENY the evidence that is right in front of you – some of it is very well-documented and *cited* in this article. You are not interested in truth – but pushing lies and half-truths to get your side to win at all costs. It’s sad and pathetic frankly.

  • Sidhecat

Egan, it is obvious that you will only grudgingly admit something may have actually happened when people start getting perp-walked, and even then you may not believe it, Nixon supporters were the same way (or so my grandparents told me). So, I am not going to try to convince you of anything. But consider this, digging for a truth takes time, sometimes years, this is not an episode of CSI that can be wrapped up in a bow in 60 minutes.
Here is what we do know from this administrations past record to date, they stall and stall and stall. You have an AG held in legal contempt of Congress, because of his refusal to comply with Congressional requests for information on a different matter. Both Justice and the IRS have drug their feet on congressional queries for information on this. We are starting to see mounting evidence that Ranking Member Cummings may have (again may have) been consulting with IRS without divulging this to the Chair, a huge red flag. We also know that several members of congress, in particular the Senate are on public record demanding IRS act in light of the Supreme Court decision on speech. Add to that, the President of the United States in the State of the Union called the Supreme Court Justices out on their decision, which is very poor manners since the Justices could not respond. This is a pattern, maybe it is all just a misunderstanding we shall have to see. But in the end we are still a year or two out from this issue being resolved, so stay tuned.

  • Justwaitinforchange

Didn’t your mother teach you that lying is bad? Other than a troll – no one is trying to pass on the IRS reviewed everybody equally meme.

  • Egan Foote

Funny, you still haven’t provided any evidence. Spew all the personal attacks and create all the straw men you want, but I don’t think it’s unreasonable to ask for evidence of what you are claiming is true.

  • vassago1

Why the congressional hearing about it? I know they totally convene those all the time with zero evidence, for fun on the weekends.

This pretty well destroys the Myth of second hand smoke:

Lungs from pack-a-day smokers safe for transplant, study finds.

By JoNel Aleccia, Staff Writer, NBC News.

Using lung transplants from heavy smokers may sound like a cruel joke, but a new study finds that organs taken from people who puffed a pack a day for more than 20 years are likely safe.

What’s more, the analysis of lung transplant data from the U.S. between 2005 and 2011 confirms what transplant experts say they already know: For some patients on a crowded organ waiting list, lungs from smokers are better than none.

“I think people are grateful just to have a shot at getting lungs,” said Dr. Sharven Taghavi, a cardiovascular surgical resident at Temple University Hospital in Philadelphia, who led the new study………………………

Ive done the math here and this is how it works out with second ahnd smoke and people inhaling it!

The 16 cities study conducted by the U.S. DEPT OF ENERGY and later by Oakridge National laboratories discovered:

Cigarette smoke, bartenders annual exposure to smoke rises, at most, to the equivalent of 6 cigarettes/year.

A bartender would have to work in second hand smoke for 2433 years to get an equivalent dose.

Then the average non-smoker in a ventilated restaurant for an hour would have to go back and forth each day for 119,000 years to get an equivalent 20 years of smoking a pack a day! Pretty well impossible ehh!

Smoke Free Florence used federal dollars for lobbying

FLORENCE, S.C. – A government report confirms that Smoke Free Florence, the organization behind implementing the city’s controversial smoking ordinance in 2011, illegally used funds to lobby local elected officials.

Though disciplinary action was taken, a government watchdog group is demanding the county be barred from receiving federal dollars as a result of the violation.

It began in April of this year when Cause of Action (CoA), an advocacy group located in Washington, D.C., accused Smoke Free Florence of misusing monies from a $6 million grant used in an anti-smoking campaign that assisted with passage of a new smoking ordinance in the county’s largest municipality.

The report, which included roughly 19 months of research, concluded that Smoke Free Florence misused grant monies from the American Recovery and Reinvestment Act of 2009. The monies were managed through the Center for Disease Control (CDC) and facilitated through the S.C. Department of Health and Environmental Control (DHEC) and Circle Park Behavioral Center in Florence.

A separate report from the U.S. Government Accountability Office confirmed funds were improperly used, but only had DHEC repay $247.79 in funds deemed misused and required some staff members to attend additional ethics training.

Dan Epstein, CoA executive director, said that isn’t enough, not by a long shot.

“Ultimately, what needs to be happening on behalf of the taxpayers is (that) Florence County, South Carolina, can never receive another federal dollar ever again until it shows it has proof of concepts for ensuring that federal funds aren’t misused,” he said.

Epstein and the CoA report point to documentation – personal emails and meeting minutes for the most part – that it obtained through Freedom of Information Act requests that show DHEC staff lobbying members of the Florence City Council to support a smoking ordinance. It shows that they attempted to manipulate meeting minutes to, Epstein said, mask their involvement in influencing the passage of the ordinance.

At the heart of the CoA report lie a series of emails among Smoke Free coalition volunteers and DHEC employees attempting to sway the votes of two Florence city councilmen, Glynn Willis and Buddy Brand, to support the ordinance. One email from Lori Phillips, a DHEC employee, recounts a conversation between herself and Florence City Councilwoman Octavia Williams-Blake – a Democrat and the smoking ordinance’s chief proponent – in which she said possible political ramifications and re-election implications for the two Republican councilmembers was keeping them from supporting the measure.

“I asked Octavia what we could do to help make up Glynn and Buddy’s minds,” Phillips wrote in the email. “She said that the arguments about this being non-Republican hit home with them and they are about getting re-elected. She said they need to know that a large section of the residents in the City of Florence want this. I shared that we will have poll results to back this up.”

Other emails discuss political strategy and show Phillips, as well as other DHEC employees, strategizing ways to convince Willis and Brand. The two councilmen later faced criticism from the Florence County’s Republican Party for their eventual support of the ordinance.

What’s more, the report show that Phillips, as well as another DHEC consultant, Ian Hamilton, advocated minutes of Smoke Free Florence meetings be changed and that certain details about DHEC’s involvement be removed. Officials with Circle Park Behavioral Center, who served as a fiscal agent to disperse the grant funds from DHEC to implement the coalition program itself, confirmed that they had issued a complaint to DHEC regarding this incident. They said that the meeting minutes were not altered.

Williams-Blake said she wasn’t surprised that a group like CoA had filed a report related to the smoking ordinance. The source of much controversy communitywide, stemming mostly from conservative activists claiming the move violated civil liberties, Florence’s smoking ordinance debate was always a hot-button issue.

With regards to her interaction with Phillips and other members of the coalition, Williams-Blake acknowledged that she was contacted by the group several times to discuss the ordinance.

“It was always sort of talking about where we were at in the process of voting or did I think it was going to pass,” she said.

Shortly after the CoA report was issued, the CDC launched its own investigation into Florence County and others named in the report. They concluded that lobbying had in fact occurred in violation of the CDC’s lobbying guidelines, resulting in DHEC refunding the $247.79 related to “planning activities,” according a report from the U.S. Government Accountability Office. Staff members were also required to receive additional training on lobbying restrictions under the CDC’s guidelines.

“At the time of the event discussed, DHEC responded to the CDC’s inquiry, and DHEC agreed to follow CDC’s recommended remedies,” a statement issued by DHEC said. “CDC requested two remedies, both of which were completed, with follow-up sent to CDC in June of 2011. Furthermore, DHEC prohibits lobbying activity by employees in their official capacity.”

A CoA spokesperson said the CDC’s actions “missed the mark” and that harsher action should be taken.

As of Friday, Florence County is still receiving some federal dollars for select grants but other federal dollars are run through the state, according to County Administrator K.G. “Rusty” Smith Jr.

  • Egan Foote

Not arguing anything. Simply asking for evidence. And literally no one has been able to respond with any.

“Obama secretly gives billions to UN global warming” Senator Inhofe

Hello, I am Senator Jim Inhofe, Republican Senator from Oklahoma, Ranking Member of the Senate Committee on Environment and Public Works, and chief critic of President Obama’s far left green agenda
Over the past decade, I have been leading the charge in Washington to make sure the global warming hoax is exposed. A big part of that effort has been putting the spotlight on what takes place at the UN’s annual global warming conferences. While I have been unable to travel to the last few conferences, I have counted on groups like CFACT to provide “on the ground” reports. This year’s UN conference is in Doha, Qatar and I’m pleased that Lord Christopher Monckton is there working with his partners, including CFACT Executive Director Craig Rucker and Marc Morano of ClimateDepotdotcom. I’m certainly looking forward to the release of Climate Depot’s new report that debunks the alarmists’ extreme weather claims.
The last time I attended a global warming conference was in 2009, when I spent only three hours at their gathering in Copenhagen. I arrived just after President Obama, Secretary Clinton, and Senator Kerry promised world leaders that the United States would act on cap-and-trade. I was in Copenhagen as a one-man truth squad: I said that the United States Senate would never ratify the Kyoto treaty or pass cap-and-trade. I was right, and now even the liberal media is admitting that these conferences are pointless. As Der Spiegel put it, the conference in Doha is “turning into a farce.” The UK Guardian said that “Doha is a byword for stalemate and failure” and the New York Times reported that after the failure of the Rio+20 conference held in June, “more and more people may be ignoring these global confabs.”

It’s not surprising that this year’s conference has been ignored. Remember EPA Administrator Lisa Jackson admitted to me that EPA’s global warming regulations are based primarily on the now exposed Climategate science of the completely discredited UN IPCC. The Atlantic Monthly said of Climategate “the stink of intellectual corruption is overpowering.” And the UK Telegraph wrote that “This is the worst scientific scandal of our generation.”
Of course, the focus of this year’s global warming conference – like all the conferences before – is not the environment. It’s about one thing: spreading the wealth around. As the Associated Press reported, “one of the main challenges will be raising climate aid for poor countries at a time when budgets are strained by financial turmoil.”
Three years ago, President Obama helped create a United Nations Green Slush Fund that would redistribute over $100 billion from developed countries to developing countries. While he has been racking up huge deficits and talking up tax increases, the President has already sent billions of American taxpayer dollars to the United Nations – and he’s managed to do it quietly so that no one will notice.
How many billions have already been handed over in the last three years? It’s hard to tell. There appears to be little in the way of transparency. Bloomberg reports that the European Union, the United States, Japan and other developed nations paid out in the range of $23 to $34 billion.
Of course, this is just the beginning. United Nations Climate Chief Christiana Figueres explained her job this way: “It is the most inspiring job in the world because what we are doing here is we are inspiring government, private sector, and civil society to [make] the biggest transformation that they have ever undertaken. The Industrial Revolution was also a transformation, but it wasn’t a guided transformation from a centralized policy perspective. This is a centralized transformation that is taking place because governments have decided that they need to listen to science. So it’s a very, very different transformation and one that is going to make the life of everyone on the planet very different.” This is the top UN Climate chief: she sees herself as the overseer of “transforming” the lives of everyone on the planet.
At the global warming conference in Milan, I asked an African delegate who I knew why he had attended and he said, “It has nothing to do with the science; it’s because it’s the biggest party of the year.” It’s time to put an end to these lavish, absurd global warming parties and focus on the real problems that we face.

  • Egan Foote

I’m not demanding “more” evidence. I’m asking for ANY evidence.

    Illicit Lobbying
Report: Local health departments illegally used federal stimulus money to lobby

    April 16, 2013 2:15 pm

At least seven local health departments illegally used stimulus grant funds to lobby for greater taxes and restrictions on tobacco and unhealthy foods, according to a report released Tuesday by a nonprofit watchdog group.

The stimulus-funded Communities Putting Prevention to Work (CPPW) program disbursed about $373 million intended to educate the public about tobacco use and obesity. Federal law prohibits grantees from using the funds for lobbying activities.

According to the group Cause of Action, local health departments from Alabama to California used the funds to devise or promote legislation designed to curb tobacco use or combat obesity.

The report detailing the allegations is the product of a 19-month investigation into the CPPW program.

“[Cause of Action’s] investigation revealed that CPPW money went to support lobbyists and public relations companies who used taxpayer dollars to push laws and agendas that would lead to tax increases on tobacco and high calorie products,” the report said.

The report said illicit uses of CPPW grant funds “essentially transform[ed] the CPPW program into a conduit for lobbying for higher taxes and bans on otherwise legal consumer products.”

Federal law prohibits grant recipients from using federal grant funds to influence “an official of any government, to favor, adopt, or oppose, by vote or otherwise, any legislation, law, ratification, policy, or appropriation.”

Internal guidance from the Centers for Disease Control and Prevention (CDC), which administers the CPPW program, clarifies that the law applies “specifically to lobbying related to any proposed, pending, or future federal, state, or local tax increase, or any proposed, pending, or future requirement or restriction on any legal consumer product.”

Cause of Action executive director Dan Epstein criticized the CDC for faulty oversight in an interview with the Washington Free Beacon. He also said specific CPPW grantees may have “committed not just violations [of lobbying prohibitions], but fraud.”

According to internal communications from South Carolina’s Department of Health and Environmental Control (DHEC) obtained by Cause of Action through public records requests, DHEC officials altered meeting minutes in order to hide the involvement of officials involved in grant fund disbursements after CDC expressed concerns about the use of grant funds for lobbying activities.

“The DHEC stated outright that the purpose of altering the minutes was to hide the fact that its CPPW program coordinator had directed illegal lobbying in the pursuit of smoke-free ordinances,” according to the Cause of Action report.

The DHEC did not return a request for comment.

DHEC grant activities, like those of other state health agencies examined in the report, were explicitly geared toward specific legislative goals. Its application for CPPW funding said it would use taxpayer funds to “increase the support for and adoption of comprehensive smoke-free laws.”

While that proposal and similar ones from other states appeared to violate laws governing the use of federal grant funds, Epstein says the CDC has made no effort to effectively oversee the CPPW program.

“It’s not just a sign of misuse of taxpayer dollars,” Epstein said. “In fact, there’s some indication that the CDC encouraged this to occur.”

Previous investigations of the CPPW program have produced similar findings.

According to the inspector general for the Department of Health and Human Services (HHS), CDC’s parent agency, federal guidelines for CPPW grant recipients “appear to authorize, or even encourage, grantees to use funds for impermissible lobbying.”

Members of the House Committee on Energy and Commerce cited that report and apparent violations of the lobbying prohibitions in multiple communications with HHS Secretary Kathleen Sebelius regarding the CPPW program. The committee’s investigative panel examined the program during a 2012 hearing.

Annual CPPW disbursements are scheduled to grow to about $2 billion in 2015. When expenditures increase six-fold, Epstein said “we’re in a serious situation, because we’re going to undoubtedly see six times the fraud.”

Florida’s Miami-Dade County Health Department, one of the agencies singled out in Cause of Action’s report, denied any wrongdoing in a statement emailed to the Washington Free Beacon.

The Department “did not utilize any of the CPPW funding for lobbying activities, nor does the Department have any reason to believe that any of its contracted providers did so either,” said spokeswoman Olga Connor. “The Department of Health’s contracts specifically bar any provider from utilizing the CPPW funds for any type of lobbying activities.”

The CDC did not return request for comment. Miami-Dade County was the only local government highlighted by Cause of Action to return a request for comment.

Agree, everyone should have skin in the game. 14% for people earning less than $150K and 18% for those making more. There’s a whole cottage industry of accountants and lawyers and IRS agents that would have to find meaningful purpose to the economy then.

  • vassago1

    Pleading the 5th for starters.

  • Egan Foote

    What actions?

  • cmdprompt

Let’s see… the IG found otherwise. They admitted it. Lerner took the 5th because she didn’t do anything wrong… oh snap… probably not. You will one day regret your complicity with this activity. If these arsehats get away with it, they will just keep pushing the envelope.

  • Egan Foote

Who is “they” and where does it say they admitted to targeting groups with conservative sounding names? The IRS scrutinized all groups. There is simply no evidence that there was political motive, nor has anyone answered my question offering any such evidence. I know you badly want it to be true, but evidence is required.

What? Wrong. The IG reached a different conclusion. Anyone with an ounce of impartiality can look at what occurred and reach the same conclusion. This collusion with the now investigating authority just raises the stink level a few notches. This is pure political corruption of the most dangerous kind. I wonder if you will be so blase about it when the shoe is on the other foot. It will happen.

  • ComeToTheDarkSideWeHaveCookies

Apparently you are blinded by your own bias. It says right in this article that by their own admission they targeted groups with conservative sounding names, while at the same time they have no evidence that groups at the other end of the political spectrum were targeted. Add to that the fact that they were considering criminal prosecution of those same groups and it is hard to believe that politically motivated intimidation wasn’t going on. I guess if there was documentation explicitly stating that that was their goal you might think that was enough evidence, but sometimes you have to go with a little less than that.

  • Egan Foote

It is actually quite good. For example, I take from your comment that you cannot provide any evidence that there was political ideology-based targeting of 501(c)(4) groups. Read you loud and clear.

  • Me

Your reading comprehension is beyond the pale.

  • Egan Foote

What exactly is the “scandal” here? The IRS scrutinized 501(c)(4) applications and discussed with the DOJ prosecuting those who submitted false statements to the IRS. That is exactly what the IRS is supposed to do. There is still zero evidence that groups were targeted because of their political ideology. Just because you believe there to be some scandal here doesn’t make it so. Ordinarily people rely on evidence, not some gut feeling that President Obama is a Nazi so there MUST be some scandal.

  • MaryReilly

You don’t have to convict. You never have to convict. All you need is to convene a grand jury and keep putting out press releases for the next two years while you bury them with discovery requests and interrogate them without the benefit of counsel.

Parisian politics and the “my man is in the white house” mentality is transforming us from the rule of law to a thug-ocracy. Used to be, this kind of corruption would have been cleaned up and dealt with. Now, one half of the country or the other says, “no, my man is in the white house, so it’s ok”. The end result will be a government that makes Putin look good.

Part of the articles of impeachment against Nixon:

    Article 2

Using the powers of the office of President of the United States, Richard M. Nixon, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in disregard of his constitutional duty to take care that the laws be faithfully executed, has repeatedly engaged in conduct violating the constitutional rights of citizens, impairing the due and proper administration of justice and the conduct of lawful inquiries, or contravening the laws governing agencies of the executive branch and the purposed of these agencies.

This conduct has included one or more of the following:

He has, acting personally and through his subordinates and agents, endeavoured to obtain from the Internal Revenue Service, in violation of the constitutional rights of citizens, confidential information contained in income tax returns for purposed not authorized by law, and to cause, in violation of the constitutional rights of citizens, income tax audits or other income tax investigations to be intitiated or conducted in a discriminatory manner.

The Senate approves presidential appointments, both houses are required to impeach, now the senate is popularly elected, the DoJ is run by the executive and the SCOTUS is nominated by the president. The antifederalists warned us of all of this. Over 200 years ago Even James Madison the Federalist predicted Congress using the “general welfare” clause to mean literally everything. The Democrats will stop at nothing to advance their ultimate goal of a permanent One-Party rule of Government. A ruinous idea/result no matter what the party affiliation. Just understand and comply with the US Constitution. We will never constrain the lust for power. We must turn our political attention to ending deficit spending and requiring an annual budget that dictates the spending priorities that have been debated and agreed upon. No agreement? Simple; no spending. Next step; new politicians that will take their cue from those they represent. The people must regain control of the politicians with their limitation of tax dollars.

  • chukalukabus

Correct. You either plead the 5th or you don’t. You can give identity information only in the context of confirming that you are the person actually noted on the supeona… then declare your rights. That is it. You cannot make a statement of innocence and then decide to invoke the 5th when questioned upon that statement of innocence. That is contempt.

There is a legal Latin term for this construct. Forgot it.

Issa is doing everything in his power. There is no ace in the hole. There will be no special prosecuter because that legally has to go thru Holder’s DOJ. Holder has been illegally pre-pardoned by BHO for anything anyway. All this has to go thru the judiciary. That is the only option. That will take years.

Remember, BHO had a closed door meeting with the SCOTUS on day 2. Unprecendented in US history. That meeting alone is enough to scare the daylights out of every Federal judge in the USA. The modus of declaring “no standing with the court” will continue unabetted.

  • IndianSoul

I’ve read the emails and it all seems to point to Tyranny and that’s not good. There’s one other thing that disturbs me and that is that Lerner and the others have spent a lot of time concentrating on how to set up a possible defense for their actions. My point is they spend time (Taxpayer Dollars in the form of their wages.) working to hinder the very folks who are trying to save taxpayer dollars. None of this is good. In closing I pray that the Mainstream Media will jump on this story and perhaps voters will wake up and see the light. The only chance our Free Country has at surviving will require on a purging of Lerner and her kind. The purging must happen on Election Day, starting in 2014 and concluding in 2016 when the Oval Office gets a makeover. Being entrusted with the authority to regulate comes with a very large responsibility of having Integrity. From looking at this it appears they don’t even know the meaning of the word.

This is nothing more than a witch hunt from the republican’s in office that don’t ever seem to help work on any REAL legislation for important issues. Instead we get hearing after hearing, and no action as usual. Let’s send these guys packing in November. I am tired of the party of NO.

  • chukalukabus

And the DOJ response was? Correllation is not cause. However, considering the modus of the America Last policy of Eric “the bagman” Holder…

It would not suprise me one bit if it was not Holder who contacted Lerner in the first place. Hell, the whole operation could have been directed from the DOJ. It fits in nicely with Holders decades long corruption and crime spree.

It bears noting that the most recent venture into totalitarian suppression of the people in Nevada appears to be a land grab scheme that none other than Harry Reid cooked up with communist Chinese. The real problem is that he had a lot of help from a compliant multitude of government agencies.

To sum up the government under the guise of BHO’s leadership, I think it is best served to quote his most trusted advisor and the person who is actually running the country due to BHO’s lack of interest:

    First, BHO Oct. 2010:

“We’re gonna punish our enemies and we’re gonna reward our
friends who stand with us on issues that are important to us.”

    Second, Vlaerie Jarrett Nov. 2012:

“After we win this election, it’s our turn. Payback time. Everyone not
with us is against us and they better be ready because we don’t forget. The
ones who helped us will be rewarded, the ones who opposed us will get what they
deserve. There is going to be he|| to pay. Congress won’t be a problem for us
this time. No election to worry about after this is over and we have two judges
    ready to go.”

This is going to get worse before it gets better folks. These genetically defective control freaks who never matured intellectually or morally past the 6th grade have been unleashed upon the general population of the USA. If you work and pay taxes, you are the enemy to them.

Yes, this administration and government has declared war on the citizens of the United States of America who disagree with their communist policies. And people who are citizens of good standing under the Consititution must now be punished for their beliefs in said Constitution.

  • albundy57

Let’s get this woman and her co-conspirator at the DOJ under arrest. Schedule the initial hearings/court dates for AFTER Obama leaves office so he can not pardon them! Then, once Obama is gone, prosecute them fully!!! Take away the retirement she is living on. Strip them of all government benefits. And make sure it is a federal crime so they do time and lose their ability to vote/have weapons/etc. Using your federally appointed position in unlawful ways should suffer the worst punishment imaginable.

Thomas asked, “How am I supposed to keep the low-level workers motivated when the public believes they are nothing more than low-level workers and now will have no respect for how they are working cases?”
Complaining about no respect??? There are plenty of ways for “the public” to describe these “workers” where their pay literally takes bread off of our (those who work) tables.
How about motivating IRS workers with a paycheck? Or how about trying Walmart tactics like “finish your work before your shift is over or we will find someone who can”?
These emails certainly paint a picture of the culture within the IRS that is seriously lacking in professionalism.

  • Hawkdriver1961

That old Democrat tact…..when caught, whine that both sides do it…..without any proof.

  • Boon Companion

    The topic of what?

  • TheRMSDave

Watergate pales in comparisan to this scandal. Google the articles of Nixon’s impeachment and take three minutes to read them.

  • Steve

These definitely came from orders from the top. Lerner would not have the political push to initiate this kind of thing on her own. I ho, she was trying go cover HER ass with these emails.

  • Andrew Thomas Swartz

    The investigation, that is.

  • Andrew Thomas Swartz

OK. How do you plan on paying for this #witchHunt?

  • Andrew Thomas Swartz

    Very insightful commentary.

  • Tomtom28

The entire Obozo administration should be in prison.

  • Andrew Thomas Swartz

Both the Democratic Party and the GOP are dirty. The time has come to stop arguing with each other and act in a reasonable manner. The Government should be by the people & for the people: arguing and cutting back-room deals does nothing to accomplish this. This is why we need a Reasonable Political Party, led by women. #EqualRightsAmendmentIsBackOnTheTableForDiscussion.

You have a strange concept of ” justice”.
Using the IRS and DOJ to harass and suppress speech to further “justice” eh Tovarish?

  • Lurch47

Commies have taken over the government! Gee, Thanks, Low info voters!!

  • S&A

Asking the DOJ about possible charges is the job of the DOJ. Learner was the driving force, get some perspective.

  • PNWShan

  • mdfield1

Of course they conspired with each other. Virtually EVERY Obama Czar run Federal Agency does all they can to help the other agencies to further Obama’s agenda which include attaining still MORE power and control.

  • souphands

I’m shocked to find that the IRS consulted with the DOJ on the topic of …. justice.

  • CaMaven

    None of their $%$&*! business!

  • DixT

Uh . . . . one of the email states “The DOJ can piece together some emails” accusing Conservative groups of lying!!! That sure sounds “fishy” to me—WHY not just SHOW where they allegedly lied—WHY would anyone have to “piece together” something, to prove it’s true???? Hmmmmmmmm.

  • http://grumpyelder.com/ Grumpy

I’d say there’s probably more than enough to convict Lerner, but I don’t think she’s smart enough to cobble this kind of conspiracy together without some guidance.. Who Ever that Guidance is need to spend some time making little rocks out of big ones

  • PNWShan

If you go back to some of the things these groups had to report on their applications – what books they read, names of everyone in the group, etc. – it would be difficult to not make an error. As to political involvement, the IRS has somewhat fuzzy definitions of what constitutes “education” and what constitutes “political activity”. E.g., if a local politician or candidate attends a lecture on the Constitution, did that suddenly become a political event?

  • NoBigGovDuh

Sounds like this was after the alleged targeting. And it is a valid concern why groups are allowed to make false statements on federal forms. They need to follow the law. If they don’t then you can’t prosecute welfare fraud properly.

The Chicago Way – put a Chicago slum landlord in the WH and what do you get — lies, deceptions – prey on the poor

  • Crystallite

Perhaps Eric the Red needs the $15 million he has just requested of Congress for his own defense.

  • Stan321

Man where you been? It came out the day the feds withdrew that Reid and his son were involved. It is all over a solar power plant project they are involved with.

  • Stan321

I agree completely. Jarrett is the head of the snake the way I see it.

  • Tim McCarthy

Prosecute all involved. No immunity for anyone. Jail only. Period.

  • LadyImpactOhio

I was part of the little band of warriors who started to cobble all this together 2 years ago. Of course at the time we were called conspiracy nuts. My guess is Jarrett was the architect of this.

    “It ain’t a conspiracy if it’s true.”

It is obvious that using Federal power for political purposes is more widespread than we fear. With the DOJ involved we now have two cabinet secretariats involved in this debacle. Secretary of the Treasury (IRS) and the Attorney General (DOJ). I really think its time for a Special Counsel to step in to de politicize this. I would not be shocked if the whole BLM versus rancher thing is a political/cronyism action sponsored by Sen. Reid. This is really quite ugly.

  • philips66

Don’t worry Eric Holder is ON THIS! /sarcasm

  • cd
  • Tony Pilcher

Time for Congress to stop all IRS funds until they get real, honest answers from anyone in the IRS. We need to investigate and prosecute many more people than just Lerner. We do that, someone will start speaking.

  • Jeffersonian

this is re-donk-u-lous! We need to stop sending our money to the IRS! They can’t arrest all 100 million that are left paying the taxes that they turn around and hand out to illegals, slackers, and the welfare queens. They just don’t have a lick of conscious left! To think that the people working for the Fed’s are allowing this to happen just shows how pathetic they are, and that Federal Workers should all be charged with a crime!
