Judge Dismisses Obamacare Lawsuit Targeting Congressional Health Care

DC Superior Court Judge Herbert B. Dixon Jr. dismissed a FOIA lawsuit Judicial Watch filed on behalf of DC resident Kirby Vining regarding Congress’ enrollment in the DC Small Business Exchange. Although the DC government acknowledged that Congress is not a small business under DC law, it cited a 2013 Office of Personnel Management ruling which claimed federal law overrides DC law on this matter. Since then, Vining filed a notice of appeal, but he can only bring the suit in Superior Court again if the appeals court reverses this ruling. Here is a quote from DC Health Benefit Exchange Authority Executive Director Mila Kofman on the ruling:
“All our customers are important to us,” she said. “We are pleased that we can continue to have Congress as one of our customers.” As of Jan. 11, according to the authority, 13,711 members of Congress, their staff, spouses and dependents were enrolled, comprising nearly 90 percent of those in the small business exchange.
