Judicial Watch Argues Illegal Day Labor Case in Court

Today, Judicial Watch, representing several town of Herndon residents, brought its case against illegal “day laborer sites” before Fairfax County Circuit Court. Lawyers for the town of Herndon argued that the town residents did not have standing to file the lawsuit.

William Hurd, the former Virginia solicitor general who argued the case for Judicial Watch, said Virginia Supreme Court precedent does give taxpayers the right to file suit opposing local government action. Hurd also made absolutely clear that the town knowingly and deliberately violated federal immigration law when they voted to establish the site by facilitating illegal activity.

Hurd began his argument on behalf of Judicial Watch by reminding us that America is a nation of immigrants, but that it is also a nation of laws.

Among some of the town of Herndon’s excuses for the day labor site is that they don’t have the authority to enforce federal immigration laws. Hurd reminded the court that “whether or not they have the authority to enforce the law, they certainly do not have the authority to flout it.”
