The U.S. Environmental Protection Agency (EPA) has completed its search for and
review documents responsive ~he Freedom Information Act request that issue the
above-referenced litigation. EPAs search for responsive agency records consistent with the
Plaintiffs Freedom oflnformation Act (FOIA) request, clarified within the Joint Status
Report filed with the court August 14, 2017.
EPAs search and production yielded the following results:
421 responsive documents, including emails and attachments;
273 total documents released;
258 documents released full (RIF); documents released with redactions;
Portions emails were redacted under FOIAs Exemption the attorney client and deliberative process privileges,
and Exemption personal privacy;
148 documents withheld full;
The 148 documents withheld full related EPAs response
the December 14, 2014 Government and Accountability Office
(GAO) report concerning EPAs use ofthe Thunderclap social
media platform; included the attached index, withheld documents
relating the GAO report contained internal, confidential
communications concerning legal issues between EPA
attorneys and EPA employees and were withheld under
FOIAs Exemption the attorney client privilege and/or
the deliberative process privilege;
