Judicial Watch: Appeals Court Hearing on Taxpayer Lawsuit Fighting Against Funding for Illegal Alien Students

(Washington, DC) – Judicial Watch announced an appeals court hearing will be held Thursday, November 3, 2016,  on whether to reinstate Judicial Watch’s taxpayer lawsuit seeking to end University of California Regents expenditures of as much as $27.1 million for non-resident tuition waivers and financial aid to illegal alien students attending University of California schools (Earl De Vries v. Regents of the University of California (No. 555614)). The appeal will be heard by the Court of Appeal of the State of California, Second Appellate District, Division Seven.

The taxpayer lawsuit filed in August 2014, notes that “under federal law, unlawfully present aliens generally are ineligible for State or local public benefit.”  While federal law allows certain exemptions, according to U.S. Code, it does so “only through the enactment of a State law … which affirmatively provides for such eligibility.”  While the State of California passed such a law granting exemptions to California State University schools and California Community Colleges, it did not do so in the case of the University of California, making tuition waivers and grants awarded by the UC Board of Regents unlawful.
