STATUS UPDATE INTERNAL REVENUE SERVICE
Under the Freedom Information Act, U.S.C. 552, plaintiff Judicial Watch, Inc., submitted four requests the Internal Revenue Service that are issue this case. During the administrative review these requests, the Service acknowledged receipt each these four requests and advised the plaintiff that would not position provide response the requests within the applicable timeframes. Since this litigation began, however, the Service has produced Judicial Watch 3,287 pages records, and the Services production ongoing. accordance with the parties scheduling proposal, submitted the Court January 22, 2014 (Docket Entry No. 14), the Service has made three monthly productions the plaintiff, through counsel for the Service. February 26, 2014, the Service produced 209 pages records. March 31, 2014, the Service produced 1,641 pages records. Today, April 30, 2014, the Service producing 1,437 pages records. the scheduling proposal, the parties suggested that the Service would include this status update estimated timeline for the remaining rolling production records. The Service making significant progress producing records the plaintiff, demonstrated the 3,287 pages records released thus far. However, due the broad scope the requests issue and the large number potentially responsive records, the Service not yet position provide the Court with estimated timeline for the remaining production records.
The Service thus respectfully suggests that (1) the Service continue its monthly rolling production responsive, non-exempt records the plaintiff, with production due the end each month; and (2) the Service submit another status update the Court August 29, 2014, regarding the Services continued progress producing records the plaintiff. the unlikely event that the rolling production concludes before August 29, 2014, the Service will notify Judicial Watch that production has concluded and file status update with the Court that time.
Counsel for the Service has consulted with counsel for Judicial Watch regarding this proposal, and counsel for the Service understands that Judicial Watch consents it.
