Defendant Department State State submits this status report (1) update the Court its search for records potentially responsive FOIA Request among information
transferred from the Federal Bureau Investigation FBI State, and (2) propose
production schedule for the non-exempt portions responsive documents subject FOIA.
FOIA Request seeks [a]ny and all emails former Secretary State Hillary
Rodham Clinton concerning, regarding, relating the September 11, 2012 attack the U.S.
Consulate Benghazi, Libya. Complaint (ECF No. 1). date, State has produced
Plaintiff, via its FOIA web site and via email, total 343 documents responsive FOIA
Request with redactions appropriate. previous filings, State reported that the FBI sent letter State indicating that
the FBI would providing State certain information that may include its agency records.
State Mot. Vacate Briefing Schedule (ECF No. 33). State further reported that had,
the interest reducing the issues litigated, agreed conduct searches the information
being transferred from the FBI State for records responsive FOIA Request
notwithstanding that they were not State possession and control the time the FOIA request

was made. Id. State further reported that the FBI completed the transfer information
State August 2016. Def. Status Report (ECF No. 34). the date this filing State has loaded all but one the eight discs
provided the FBI into document management system and searched them using key word
search terms and the date range specified the FOIA request. State has determined that the one
disc that remains loaded not reasonably likely contain additional responsive records.
State currently working determine whether any the documents that
satisfied the search terms are agency records responsive Plaintiff FOIA request. must then
review those documents determine what, any, exempt information must withheld from
the responsive documents. Accordingly, State proposes rolling production schedule, under
which State would make its first production any non-exempt responsive records subject
FOIA September 30, 2016, and complete production later than October 31, 2016. its August 2016 status report, State noted its expectation that would complete the
uploading the discs later than August 12, 2016. That estimate, however, was formed just
days after receiving the discs from the FBI and turned out overly ambitious. State now
anticipates completing the uploading process August 26, 2016.
This disc contains the collection documents previously returned the State Department
former Secretary Clinton, which has already been reviewed the State Department and posted its FOIA website. State currently working verify that all the documents this disc
are fact duplicative those previously reviewed State and searched for records responsive this case.
