The Supreme Court’s Habeas Corpus Ruling & Border Security

“I’ve often observed that the best immigration reform would be to actually enforce the law,” Tom Fitton stated in last week’s Weekly Update. 

In last week’s 7-2 ruling, the Supreme Court struck down the 9th U.S. Circuit Court of Appeals’s attempt to revisit the writ of habeas corpus as a right applicable to illegal aliens. With liberal Justices Breyer and Ginsburg siding with the 5 conservatives on the court, the ruling deemed it “not appropriate to apply habeas corpus to aliens seeking asylum,” Fitton states. According to Fitton, “the left was trying to create a constitutional right to have those [asylum] claims adjudicated beyond that initial determination which would have led to open borders, more so than they already are.”

As a result of this ruling, the Court authorizes the president to “enforce the law as he’s been enforcing it, as Congress has authorized – and as a result we’ve gotten the border a little more under control,” Fitton continues. What’s more, “what if we were able to expand our resources… we let the police enforce the rule of law on citizenship. Maybe congress can pass that instead of the harassment laws they’re trying to pass to enable the insurrection further?”

In opposing the Left’s often “unlawful” asylum policies, Judicial Watch is fighting for the rule of law across the country. Most recently, “we’ve sued in California and Maryland over their decisions to provide cash benefits to illegal aliens in violation of law.” In Maryland, while the court agreed with Judicial Watch initially, it ultimately sided with the government in “overturning one hundred years of Maryland state law.” “We’re appealing that decision, obviously,” Fitton continues. Ultimately, “we applaud the Trump administration’s efforts to enforce the law at our borders.”
